Regular City Council Meeting <br />Monday, September 08, 2008 <br />Page 10 <br />Mr. Munson advised that, upon his visit to the site today, work crews were in evi- <br />dence and had initiated clean up of the site; however, noted that the building had <br />not yet been secured from entry, and given the property's history of non compli- <br />ance issues, requested action as outlined, noting a reduction in anticipated abate- <br />ment costs. <br />Discussion included identifying the property (McCarron's Ponds adjacent to the <br />Armory Building); provisions of the PUD Agreement and available enforcement <br />tools under that agreement; anticipated sale of units as housing market conditions <br />improve; and impacts to those three residents occupying the units already sold. <br />Mr. Munson reviewed the property's history, owned by Cottonwood Holdings, <br />and problems in early 2000 when asingle-family home was on the site; life safety <br />issues in place in common areas, and compliant with code, that issuance by staff <br />of Certificate of Occupancy for the three units currently occupied. <br />Councilmember Willmus sought clarification on future maintenance and repairs <br />for the current occupants, and responsibility of the owners and property manage- <br />ment with association fees or lack thereof. <br />Mayor Klausing noted the validity of the points being discussed; and suggested a <br />broader discussion, outside the realm of the current request, of what recourse the <br />City has when a project similar to one of this size runs into problems, in a pro- <br />active effort to avoid additional problems and impacts to the surrounding commu- <br />nity. Mayor Klausing questioned if this was a topic for further discussion at the <br />HRA level. <br />Councilmember Pust, as Council Liaison to the HRA, advised that the issue <br />should be discussed at the HRA level; and noted that she had been unaware of the <br />situation prior to tonight's discussion. <br />Councilmember Pust suggested that the abatement process move ahead tonight; <br />with staff review of the PUD conditions of approval and report to the City Coun- <br />cil and HRA; as well as addressing potential issues related to Association fees and <br />responsibilities, given the lack of sold units in this 40-unit building, and in con- <br />sideration of past issues with condemnation considered with the single-family <br />home and same owners involved; and a determination of whether any subsidies <br />were involved in redeveloping this property, as part of those discussions. <br />Mayor Klausing noted that the property owner was not present. <br />Roe moved, Klausing seconded, directing staff to abate public nuisance violations <br />at 185 N McCarrons Boulevard by hiring a general contractor to correct existing <br />code violations, as detailed in the Request for Council Action dated September 8, <br />2008, at an estimated cost of approximately $1,200.00; and further directing that <br />
