Regular City Council Meeting <br />Monday, September 08, 2008 <br />Page 14 <br />Roll Call [Original Motion as Amended] <br />Ayes: Roe; Ihlan; Willmus; Pust; and Klausing. <br />Nays: None. <br />Councilmember Roe opined that the current rate of abatements and resolution on <br />non compliant code issues was largely coming about through HRA funding of <br />those enforcement issues; and opined that it was great to see action taking place. <br />Mayor Klausing concurred. <br />13. Business Items -Presentations, Discussions <br />a. Centennial Gardens Apartments Update <br />Mayor Klausing noted that at a previous City Council meeting held August 11, <br />2008, Mr. Jack Cann, an Attorney with the Housing Preservation Project, had <br />raised several concerns regarding recent tenant rent increases and eviction notices; <br />and questioning of the City Council's authorization of the issuance of tax exempt <br />bonds for renovation of the Centennial Gardens Apartments. <br />Mayor Klausing referenced a letter dated September 3, 2008 addressed to Mayor <br />Klausing from Mr. Cann, and copied to Councilmember Ihlan. <br />Other documents referenced were included as bench handouts were an e-mail <br />from Finance Director Miller to all Councilmembers and as part of this record, as <br />directed by City Manager Malinen, and consisting of that cover a-mail directive; a <br />copy of the Regulatory Agreement among U. S. Bank National Association, The <br />City of Roseville, MN and Gardens East Limited Partnership dated May 1, 2008; <br />and a letter dated September 5, 2008 from Briggs and Morgan, the City's Bond <br />Counsel to Mr. Miller reviewing the bond issue process. <br />Finance Director Miller, at the direction of City Manager Malinen, introduced <br />representatives of Centennial Gardens Apartments to personally address the con- <br />cerns of the City Council, as raised by Mr. Cann. <br />Councilmember Ihlan moved a point of procedure, expressing concern that what <br />she had originally requested was simply an update on the bond issue terms con- <br />sisting of staff information; and opined that she had not requested a presentation <br />from the owners and/or attorneys from the apartment complex, and was concerned <br />that if the owners were allowed to speak, that all parties be offered equal opportu- <br />nity. <br />Mayor Klausing assured Councilmember Ihlan, and the public, that as per past <br />City Council practice, if people were present to speak to the issue, all parties <br />would be given ample opportunity to do so. <br />
