Request by Cent Ventures II (in cooperation with Joel McCarty, property <br />owner, Old Dominion Freight Line) for the VACATION of a ROADWAY <br />EASEMENT and a PRELIMINARY PLAT of property at 2750 Cleveland <br />Avenue (PF08-039) <br />City Planner Paschke summarized the staff report dated October 13, 2008 detail- <br />ing the request of Cent Ventures II, in conjunction with Joel McCarty, for ap- <br />proval of a ROADWAY EASEMENT VACATION and approval of a PRE- <br />LIMINARY PLAT dividing the existing 5.14 acre plot into two lots. <br />Mr. Paschke advised that, in 1960, a Quit Claim Deed conveyed to the Village of <br />Roseville aten-foot wide strip of land along the north and east sides of the prop- <br />erty; and that the City Attorney had determined that the land in question was not <br />an easement, and therefore the City was unable to act on the EASEMENT VA- <br />CATION request. <br />Therefore, the request before the City Council was for approval, as recommended <br />by the Planning commission, of the PRELIMINARY PLAT for 2990, 2996, 3008, <br />and 3010 Cleveland Avenue, with conditions as outlined in Section 8 of the re- <br />port. <br />Discussion included clarification by City Attorney Squires and the legal opinion <br />related to the request for vacation of easement based on the Quit Claim Deed and <br />dedication of a portion of Lot 1 as right-of--way on the proposed plat; and poten- <br />tial future dedication of that area as right-of--way as well as all necessary ease- <br />ments for Cleveland Avenue or other parcels as maybe indicated. <br />Klausing moved, Willmus seconded, approval of the PRELIMINARY PLAT for <br />Cent Ventures II and the property at 2750 Cleveland Avenue; based on the com- <br />ments and conditions of Section 7 of the project report dated October 13, 2008. <br />Roll Call <br />Ayes: Willmus; Roe; Ihlan; Pust; and Klausing. <br />Nays: None. <br />c. Request for approval of a REZONING and GENERAL CONCEPT <br />PLANNED UNIT DEVELOMENT (PUD) for Metro Transit (in cooperation <br />with Cent Ventures II and Old Dominion Freight Lines) to Develop a Park <br />and Ride Facility on a Portion of 2750 Cleveland Avenue (PF08-023) <br />City Planner Paschke briefly summarized the request of Metro Transit, a service <br />of the Metropolitan Council, for approval of a REZONING and GENERAL <br />CONCEPT PLANNED UNIT DEVELOPMENT (PUD) to develop a 1.2+ acre <br />lot in the northeast corner of 2750 Cleveland Avenue into afoot-level, 460-stall <br />park and ride facility. <br />
