Regular City Council Meeting <br />Monday, October 13, 2008 <br />Page 23 <br />Use Business Park District (B-6);" with publication of said ordinance to occur <br />upon Final Development PUD action. <br />Councilmember Ihlan advised that she would be voting against this motion; in <br />part based on issues she'd brought up with the Applewood Point building, and <br />opining that environmental mitigation requirements of the AUAR hadn't been met <br />by that proposal or this one. Councilmember Ihlan opined that, in her review of <br />B-6 zoning ordinance requirements, there were minimum requirements for surface <br />area green space, and expressed concern that those were not being met, as well as <br />setback requirements. <br />Mayor Klausing asked Councilmember Ihlan if she had raised her concerns to <br />staff prior to tonight's meeting so they could be addressed by staff and the appli- <br />cant. <br />Councilmember Ihlan advised that she had not, but that the issues were outlined in <br />City Code, Section 105.07, Section D, Subd. 4 and 5. <br />Mayor Klausing noted the proposed action requested in the project report; and <br />asked if between this approval and final plan approval, staff would make sure the <br />project was in compliance. <br />Mr. Paschke advised that, as part of General Concept PUD approval, staff review <br />and comment could be provided on those specific items as requested. <br />Roll Call <br />Ayes: Willmus; Roe; Pust; and Klausing. <br />Nays: Ihlan. <br />Motion carried. <br />Roe moved, Klausing seconded, approval of the GENERAL CONCEPT <br />PLANNED UNIT DEVELOPMENT (PUD), as presented by United Properties <br />for tonight's meeting; and subject to the conditions of Section 9 of the project re- <br />port dated October 13, 2008, with final approval to be considered as a separate <br />application by the City Council after all conditions and required documents and <br />permits have been submitted for final approval. <br />Staff was requested to address their review comments in relation to the PUD final <br />approval on those issues identified by Councilmember Ihlan, and any deviation in <br />those plans from City Code. <br />Roll Call <br />Ayes: Willmus; Roe; Pust; and Klausing. <br />Nays: Ihlan. <br />Motion carried. <br />
