Although the WWV1's attorney said of our original documents , and I quote, "The <br />Declaration does not provide a formula for the allocation of common expenses <br />among the lots. Minnesota Common Interest Ownership Act, 515 B, 2-108 <br />requires modern Declarations to specify the fraction or percentage for allocation <br />among the lots." The new Declaration drafted does not. <br />So, allocation by the revised Declarations does not appear appropriate as it does <br />not comply with state statutes, using percentage or fractions for allocation. The <br />attorney agreed that 99 % of associations pay by size of unit. Larger units have up <br />to 3 stories while smaller units have one or one and a half stories. In addition, <br />the larger units have larger roofs, more windows/doors to be covered, decks to <br />be detached and reinstalled, fascia and soffits, gutters and downspouts. In <br />addition, the larger units have more trash to dispose of. I have requested a <br />breakdown on siding, roofing, gutters and downspouts as the spec's <br />do not show that, but have not received. <br />1 am not against the funding for the project, but I am asking the council not to <br />approve this request as it exists now. The more equitable way is to pay for our <br />own property as WWV2 has recently done.
