6.4.1 Any Common Expense associated with the maintenance, repair, or <br />replacement of a Limited Common Element shall be assessed exclusively against <br />the Unit or Units to which that Limited Common Element is allocated, equally or <br />by actual cost per Unit or such other reasonable allocation as may be approved by <br />the Board. <br />6.4.2 The costs of labor and materials for replacement of above grade, <br />exterior siding ("Siding Replacement Costs") shall be calculated on the basis of <br />total cost per linear foot of siding and allocated as follows: <br />6.4.2.1 Siding Replacement Costs for flat walls on the front and <br />back of each Unit shall be assessed to the Owner of the respective Unit as <br />limited Assessments and shall not be included in replacement reserves. <br />6.4.2.2 Siding Replacement Costs for all other walls, including, <br />without limitation, building ends, mid-building sides created by Units of <br />different heights, courtyard walls and garage walls, shall be assessed as <br />Common Expenses in accordance with the allocation formula set forth in <br />Section 4.2 and shall be included in replacement reserves. <br />6.4.2.3 The allocations of Siding Replacement Costs provided <br />herein shall not apply to the cost of siding maintenance or siding repair, <br />which shall be assessed as Common Expenses in accordance with the <br />allocation formula set forth in Section 4.2. <br />6.4.3 Any Common Expense benefiting fewer than all of the Units but <br />not falling within Section 6.4.1 or Section 6.4.2 may, at the Board's discretion, be <br />assessed against the Unit or Units benefited equally, by actual cost per Unit or <br />such other reasonable allocation as may be approved by the Board. <br />6.4.4 Reasonable attorneys' and other professional fees and costs <br />incurred by the Association in connection with (i) the collection of Assessments <br />and (ii) the enforcement of the Governing Documents, the Act, or the Rules and <br />Regulations, against an Owner or Occupant or their guests, may be assessed <br />against the Owner's Unit. <br />6.4.5 Late charges, fines and interest may be assessed as provided in <br />Section 14. <br />6.4.6 Assessments levied under Section S15B.3-116(a) of the Act to pay <br />a judgment against the Association may be levied only against the Units existing <br />at the time the judgment was entered, in proportion to their Common Expense <br />liabilities. <br />6.4.7 If any damage to the Common Elements or another Unit or any <br />portion of the Owner's Unit that the Association is obligated to maintain <br />9 <br />
