8.5 Exemptions. The requirements set forth in this Section 8 (except Section <br />8.4) shall not apply to the following: <br />8.5.1 Certain types of antennae may be installed, following application to <br />the Board, to the extent permitted by federal law and the Rules and Regulations <br />consistent therewith. <br />SECTION 9 <br />MAINTENANCE AND REPAIR <br />9.1 Maintenance b~ Association. The Association shall provide for all <br />maintenance, repair or replacement (collectively referred to as "maintenance") of the <br />Common Elements, including all improvements thereon. In addition, for the purpose of <br />preserving the architectural character, quality, and high standards for appearance of the <br />Property, the Association shall provide for exterior maintenance upon the Dwellings <br />and/or Units, subject to the following: <br />9.1.1 The costs associated with the Association's maintenance obligations <br />under this Section 9.1 shall be funded by Assessments determined and levied in <br />accordance with Section 6. <br />9.1.2 The Association shall maintain, repair and replace roofs, gutters, <br />downspouts, exterior siding and other building surfaces. <br />9.1.3 The Association may, upon thirty days' prior notice to the Owner, <br />also undertake any exterior maintenance for which an Owner is obligated under <br />Section 9.3 and which the Owner fails to perform to standards established by the <br />Association, and assess the Owner's Unit for the cost thereof. Such cost shall be a <br />personal obligation of the Owner and a lien against the Owner's Unit. <br />9.1.4 The Association may, upon reasonable notice, elect to inspect, <br />maintain, repair or replace mechanical, structural or other components within the <br />Unit and assess the costs against the Unit, if the failure or impairment of the <br />component could result in damage to the Common Elements or other Units, <br />impair the function of any common operating system, or create a health or safety <br />hazard. The Association may require that any such component be maintained, <br />repaired or replaced by the Owner thereof to the satisfaction of the Association <br />within a period of time established by the Association. <br />9.1.5 The Association's obligations for maintenance shall exclude any <br />items not specifically required to be maintained by the Association under this <br />Section 9.1, including but not limited to porches, patios, decks, foundations and <br />foundation walls, Dwelling walls, floors and ceilings, structural components, <br />interior parts of the Dwellings, garage doors and exterior entry doors and frames, <br />exterior window frames, door and window hardware, garage door hardware, <br />17 <br />
