Approve aOne-Day Off-Site Gambling Permit for Como Area Hockey on <br />October 25, 2008, at the American Legion, 700 W County Road C <br />Ihlan moved, Willmus seconded, approval of a One-Day, On-Site Gambling Per- <br />mit for the Como Area Hockey Association, on October 25, 2008, at the Rose- <br />town American Legion, located at 700 W County Road C. <br />Roll Call <br />Ayes: Willmus; Roe; Ihlan; Pust; and Klausing. <br />Nays: None. <br />8. Consider Items Removed from Consent <br />a. Approve a Contract for Geotechnical and Environmental Investigations for <br />the Twin Lakes AUAR Subarea I Infrastructure Improvements (Former <br />Consent Item 7.e) <br />At the request of Mayor Klausing, City Manager Bill Malinen briefly reviewed <br />the item. <br />Mayor Klausing asked if the document included in the agenda packet dated Octo- <br />ber 9, 2008 from Braun Intertec (Proposal BL-08-02387), and setting out the <br />scope of services, constituted the actual contract, and whether it would be subject <br />to City Attorney review prior to final approval. Mayor Klausing opined that this <br />would constitute an unusual contract format. <br />Public Works Director Duane Schwartz advised that, when the design work, un- <br />der SBA contract, was originally approved it was without costs yet identified, and <br />that at that time it had been reviewed by the City Attorney. Mr. Schwartz advised <br />that this was apass-through cost, without mark-up and was based on access con- <br />siderations and based on the cost of geotechnical and environmental explorations. <br />City Attorney Jay Squires advised that the document should be subject to City At- <br />torney review and approval; noting in his brief review of the document, that there <br />were some conditions that were not acceptable based on the best interests of the <br />City; and opined the need to work with staff and Braun Intertec on refining the <br />document. <br />Roe moved, Klausing seconded, approval of a contract between Braun Intertec <br />and the City of Roseville, to complete the geotechnical and environmental inves- <br />tigations for the Twin Lakes AUAR Subarea I Infrastructure Improvements," at a <br />cost not to exceed $30,120; subject to City Attorney review. <br />
