Regular City Council Meeting Monday, October 20, 2008 Page 5 Councilmember Ihlan advised that she would be voting in opposition to the mo- tion, while supporting the City Attorney review of terms before approval; how- ever, opined that it was premature to do geotechnical evaluation for public infra- structure or preliminary environmental evaluation of soils on Twin Lakes Park- way, since it was yet to be determined if it would ever need to be constructed. Mayor Klausing requested, with Council consensus, that staff provide the revised document to the City Council for information purposes, and prior to the Mayor and City Manager executing the document. Roll Call Ayes: Willmus; Roe; Pust; and Klausing. Nays: Ihlan. Motion carried. b. Approve Encroachment Agreement for Centre Pointe Business Park (For- mer Consent Item 7.f.) Public Works Director Schwartz advised that a corrected version of the proposed Encroachment Agreement, in its entirety, was posted on the City's website last Friday following original Council agenda packet distribution, and also provided by e-mail to Councilmembers. Councilmember Ihlan provided her copy of the revised document, incorporating Item 4 related to indemnification and "Hold Harmless" language, formerly miss- ing; which Mayor Klausing read. Roe moved, Pust seconded, approval of an Encroachment Agreement between Minnesota Industrial Properties Limited Partnership and the City of Roseville at Centre Pointe Business Park, 2890 - 2920 Centre Pointe Drive. Roll Call Ayes: Willmus; Roe; Ihlan; Pust; and Klausing. Nays: None. 9. General Ordinances for Adoption a. Consider enacting an Ordinance to allow the Roseville Police Department to perform Non-criminal Background Checks for the City of Roseville As previously noted, City Manager Malinen removed this item pending receipt of additional in- formation from the Bureau of Criminal Apprehension (BCA). 10.
