Regular City Council Meeting <br />Monday, October 20, 2008 <br />Page 5 <br />Councilmember Ihlan advised that she would be voting in opposition to the mo- <br />tion, while supporting the City Attorney review of terms before approval; how- <br />ever, opined that it was premature to do geotechnical evaluation for public infra- <br />structure or preliminary environmental evaluation of soils on Twin Lakes Park- <br />way, since it was yet to be determined if it would ever need to be constructed. <br />Mayor Klausing requested, with Council consensus, that staff provide the revised <br />document to the City Council for information purposes, and prior to the Mayor <br />and City Manager executing the document. <br />Roll Call <br />Ayes: Willmus; Roe; Pust; and Klausing. <br />Nays: Ihlan. <br />Motion carried. <br />b. Approve Encroachment Agreement for Centre Pointe Business Park (For- <br />mer Consent Item 7.f.) <br />Public Works Director Schwartz advised that a corrected version of the proposed <br />Encroachment Agreement, in its entirety, was posted on the City's website last <br />Friday following original Council agenda packet distribution, and also provided <br />by e-mail to Councilmembers. <br />Councilmember Ihlan provided her copy of the revised document, incorporating <br />Item 4 related to indemnification and "Hold Harmless" language, formerly miss- <br />ing; which Mayor Klausing read. <br />Roe moved, Pust seconded, approval of an Encroachment Agreement between <br />Minnesota Industrial Properties Limited Partnership and the City of Roseville at <br />Centre Pointe Business Park, 2890 - 2920 Centre Pointe Drive. <br />Roll Call <br />Ayes: Willmus; Roe; Ihlan; Pust; and Klausing. <br />Nays: None. <br />9.
