Planning Commission Meeting <br />Minutes – Wednesday, March 05, 2008 <br />Page 13 <br /> <br />At the request of Commissioner Boerigter, Mr. Paschke clarified that the approval was for four (4) <br />lots, with three for Bonestro, and 1 lot (Lot 4) owned by the City for the City’s lift station and the <br />City’s interest in the stormwater pond. <br />Applicant, Jeb Hutzinger, (1650 Highway 36 – 269, Mpls,, MN 55401) <br />was present, but <br />concurred with staff’s report and had no comment. <br />Chair Bakeman closed the Public Hearing, with no one appearing for or against. <br />MOTION <br />Member Bakeman moved, seconded by Member Martinson to RECOMMEND APPROVAL <br />OF the VACATION of CERTAIN PUBLIC EASEMENTS, based on the comments of Sections <br />4 and 5, and subject to the condition of Section 7 of the Project Report dated March 5, <br />2008. <br />Ayes: 4 <br />Nays: 0 <br />Motion carried. <br />MOTION <br />Member Bakeman moved, seconded by Member Martinson to RECOMMEND APPROVAL <br />OF the FINAL PLAT, combining eight (8) lots and/or parcels into four (4) lots, based on the <br />comments of Sections 4 and 6, and subject to the condition listed in Section 7 of the <br />Project Report dated March 5, 2008. <br />Ayes: 4 <br />Nays: 0 <br />Motion carried. <br />Chair Bakeman advised that the Case was scheduled to be heard by the City Council at their <br />March 24, 2008 meeting. <br />g. PROJECT FILE 0010 <br />Continued consideration of revisions to the City Code creating a mandatory neighborhood <br />open house for all Planned Unit Development projects <br />Chair Bakeman opened the Public Hearing for Planning File 08-004. <br />Mr. Lloyd briefly summarized the staff report dated March 5, 2008, and the proposed drafting of a <br />Zoning ORDINANCE TEXT AMENDMENT. <br />Discussion included clarifying that a required element of Section 5.2.d for an application was to <br />include a summary of the informational meeting provided to staff for the record; <br />Chair Bakeman closed the Public Hearing, with no one appearing for or against. <br />Chair Bakeman noted the written comment provided by Gary Grefenberg, 91 Mid Oaks Lane, <br />earlier at tonight’s meeting related to this item, attached hereto and made a part thereof. <br />Further discussion included the process followed to create a text amendment with specific code <br />changes provided to the City Council in a redlined copy of the code sections; and proposed timing <br />for informational meetings relative to the 60-day review period and public hearing (Section 5.2.c). <br />Commissioner Boerigter spoke in support of the proposed text amendment; opining that it made <br />sense, would provide more public involvement at a minimal cost to the City, and hopefully negate <br />ongoing complaints that the public wasn’t involved in the process. <br />MOTION <br />Member Boerigter moved, seconded by Member Gasongo to RECOMMEND APPROVAL of <br />a ZONING ORDINANCE TEXT AMENDMENT, based on the comments of Sections 4 and <br />recommendations of Section 5 of the Project Report dated March 5, 2008. <br />Chair Bakeman spoke in opposition to the motion; opining that it would not solve the problem at <br />hand; with the City had a previous practice of encouraging developers to hold open houses; and <br />that by codifying the process, it would not stop complaints about a perceived lack of due process. <br /> <br />
