Planning Commission Meeting <br />Minutes – Wednesday, April 02, 2008 <br />Page 3 <br />Mr. Lloyd advised that representatives of the Roseville Police Department and Planning <br />Division had met previously to review the proposal of Red Dog Holdings to establish a <br />pawn shop in the vacant tenant space at Rosewood Shopping Center. Mr. Lloyd noted <br />that at that meeting, the Police Department indicated that they had a good relationship <br />with Pawn America and would expect a similar relationship with Cash-n-Pawn, with the <br />Police representative further stating that City Code, Section 311 (Pawnbrokers and <br />Precious Metal Dealers) governed the licensing and operational requirements for such <br />uses. <br />Mr. Lloyd advised that Police Department staff indicated that a pawn shop is no more <br />likely to have illegal activity or police calls than a general retail business; unless a <br />substantial increase in police calls due to illegal activities or loitering in the parking lot <br />was found, at which time the CUP would be revisited, and was addressed in staff’s <br />recommended conditions as detailed in the project report related to monitoring calls to <br />the site and discretion of the Police Department. <br />Staff recommended APPROVAL of the request for a CONDITIONAL USE PERMIT to <br />allow the proposed pawn shop to operate in compliance with the requirements and <br />regulations established in Roseville City Code, Sections 1005.015, 1013.01 and 311; <br />based on the comments and findings outlined in Sections 5 and 6, and subject to <br />conditions detailed in Section 7 of the project report dated April 2, 2008. <br />Commissioner Wozniak questioned whether it was appropriate to have a condition of <br />approval that the City’s Police Department be required to provide additional monitoring. <br />Mr. Lloyd responded that this was for the purpose of reiterating notice to the applicant <br />that there would be ongoing monitoring, and that monitoring would be used as a resource <br />to evaluate criteria for continuing the CUP should any problems develop. <br />Discussion included the preference of the Police Department to avoid assigning an <br />arbitrary numerical threshold as part of the approval criteria; and clarification of the <br />location of Pawn American in Roseville (Rice Street at Larpenteur Avenue). <br />Community Development Director Trudgeon advised that the pawn shop license was an <br />additional monitoring device for the applicant for day-to-day operations, with any <br />violations potentially causing the CUP to become void as well as their license revoked. <br />Commissioner Doherty sought verification that the pawn shop would not be offering <br />check cashing services or pay day loans. <br />Mr. Lloyd advised that the pawn shop would not be offering such services, and clarified <br />that those services would fall under different City, County and/or State licensing criteria <br />and requirements, and were not part of this land use application. <br />Commissioner Boerigter questioned if the CUP would apply only to the proposed space <br />at this time, or if it could be expanded to include additional square footage within the <br />same strip center. <br />Mr. Lloyd advised that a CUP was recorded with Ramsey County and stayed with the <br />property, not the applicant; and advised that this applicant would need a new CUP to <br />operate at a different location; and could operate on the property identified in the CUP <br />application. <br />Mr. Trudgeon suggested that the Commission could specifically condition their action on <br />tying the CUP application to a specific piece of property within the strip mall, as well as a <br />condition specifying that no cash lending would be allowed; thus making it necessary for <br />the applicant to apply for an amendment to the CUP for any additional operations to <br />make sure the City and public were aware of those changes. <br /> <br />
