Planning Commission Meeting <br />Minutes – Wednesday, June 04, 2008 <br />Page 4 <br />residential parcel addressed as 2045 Loren Road comprised two (2) legal lots of <br />record, platted in 1963, with both lots exceeding minimum residential lot square <br />footage requirements. <br />Staff recommended APPROVAL of the requested VARIANCE to Roseville City Code, <br />Section 1103 and the requested RECOMBINATION MINOR SUBDIVISION, based on <br />the comments and findings of Section 5; and subject to conditions of Section 6 of the <br />project report dated June 4, 2008. <br />Applicant, Rick Cox, 2045 Loren Road – Owner since 1997 <br />Mr. Cox was present and spoke briefly of his request, following research with a <br />landscape architect, for realignment of lot lines to allow for an easier exchange of land <br />in the future, while preserving several mature trees on the lot. <br />Chair Bakeman closed the Public Hearing, with no one appearing to speak. <br />MOTION <br />Member Boerigter moved, seconded by Member Doherty to RECOMMEND <br />APPROVAL of a VARIANCE to Roseville City Code, Section 1103 to allow the <br />proposed non-radial realignment of the existing property line common to Loren <br />Acres No. 1, Lots 3 and 4, Block 1; based on the comments and findings of <br />Section 6; and subject to condition “a” of Section 7 of the project report dated <br />June 4, 2008. <br />Ayes: 6 <br />Nays: 0 <br />Motion carried. <br />MOTION <br />Member Boerigter moved, seconded by Member Doherty to RECOMMEND <br />APPROVAL of a RECOMBINATION MINOR SUBDIVISION of the property at 2045 <br />Loren Road; based on the comments and findings of Section 5; and subject to <br />conditions “b” and “c” of Section 7 of the project report dated June 4, 2008. <br />Ayes: 6 <br />Nays: 0 <br />Motion carried. <br />Chair Bakeman noted that this case was scheduled to be heard by the City Council at <br />their June 30, 2008 meeting. <br />c. PLANNING FILE 08-017 <br />Request by Ficek Investment Company, LLC, owner of 621 Larpenteur Avenue, <br />for a rezoning, right-of-way vacation, and variance to Roseville City Code, <br />Section 1005.01 (Parking Setbacks) to allow the redevelopment of the property <br />as an assisted living facility with a parking area encroachment into the required <br />setback and right-of-way <br />Chair Bakeman opened the Public Hearing for Planning File 08-017. <br />Associate Planner Bryan Lloyd noted that the mailed and published public hearing <br />notice had included a request for a right-of-way vacation, which had since been <br />withdrawn; with this request now being only for rezoning and a variance. <br />Mr. Lloyd reviewed staff’s analysis of the request to rezone the property from B-2 <br />(Retail Business District) to B-3 (General Business District) to allow the <br />redevelopment of the property into an assisted living facility, which use is currently <br />prohibited in the B-2 District, but permitted in the B-3 District. The VARIANCE request <br />would allow construction of a parking area that would encroach into the required <br />setback from a side property line adjacent to a street right-of-way. <br />Mr. Lloyd noted that the existing property currently had an older multi-tenant office <br />building and a nonconforming parking area that encroaches far into the adjacent Dale <br /> <br />
