<br />Variance Board Meeting <br />City Council Chambers, 2660 Civic Center Drive <br />Minutes - Wednesday, April 02, 2008 <br />1. Call to Order <br />Chair Daniel Boerigter called to order the Variance Board meeting at 5:30 p.m. and reviewed the <br />role and purpose of the Variance Board. <br />2. Roll Call & Introductions <br />Associate Planner Bryan Lloyd called the Roll. <br />Members Present: Chair Daniel Boerigter; Commissioners Barbara Martinson; and Jim Doherty. <br />Staff present: Associate Planner Bryan Lloyd. <br />3. Approval of Minutes <br />MOTION <br />Member Boerigter moved, seconded by Member Martinson, to approve meeting minutes of <br />March 05, 2008 as presented. <br />Ayes: 2 <br />Nays: 0 <br />Abstentions: 1 (Doherty) <br />Motion carried. <br />4. Public Hearings <br />a. PLANNING FILE 08-015 <br />Request by Aaron Gjelhaug, 894 Lovell Avenue, for a VARIANCE to Roseville City <br />Code, §1004 (Residence Districts) to allow a principal structure encroachment into <br />the required setback from the front property line. <br />Chair Boerigter opened the Public Hearing for Planning File 08-015. <br />Associate Planner Bryan Lloyd reviewed the request of Mr. Gjelhaug for a variance to <br />allow construction of a pillar-supported roof over the existing front stoop that would <br />encroach four feet (4’) farther into the required setback from a front property line. <br />Mr. Lloyd reviewed staff’s analysis of the request to allow better protection from the <br />elements, with building permits being sought to add a second level to the home and to <br />cover both of the entrances (front and side) with matching column-supported roofs. Mr. <br />Lloyd advised that the parcel, along with its neighbors to the west and east, was created <br />from an un-platted portion of the 1947 C. W. Michael’s Second Addition plat surrounding <br />the parcel. <br />Mr. Lloyd noted that in 1949, an additional twelve feet (12’) of right-of-way was added to <br />this section of the Lovell Avenue around the time the house was built, and the expanded <br />forty-two-foot (42’) right-of-way was reflected in the Registered Land Survey #301 <br />prepared in 1975. Mr. Lloyd further advised that, in 1980, the southern half of the sixty- <br />foot (60’) right-of-way was completed with the dedication of another eighteen feet (18’). <br />Mr. Lloyd advised that determining precise existing setbacks had proven difficult due to <br />maps incorrectly showing a fifty-eight-foot (58’) right-of-way, compared to the legal <br />descriptions indicating a sixty-foot (60’) right-of-way, and misaligned aerial photos. <br />Staff recommended APPROVAL of the request for a VARIANCE to Roseville City Code, <br />§1004 (Residence Districts), to allow expansion of the principal structure; based on the <br />comments and findings outlined in Section 5, and subject to the conditions detailed in <br />Section 6 of the project report dated April 2, 2008. <br />Discussion included a survey not being required as part of the application due to the <br />minor nature of the proposed four foot (4’) addition; potential right-of-way boundary <br />definition issues with adjoining properties on Lovell Avenue; clarification of the second <br />story elevations; and the nature of an apparent easement to the west of the property. <br /> <br />
