<br />Variance Board Meeting <br />City Council Chambers, 2660 Civic Center Drive <br />Minutes - Wednesday, October 01, 2008 <br /> <br />1. <br />Call to Order <br />Chair Daniel Boerigter called to order the Variance Board meeting at 5:30 p.m. and reviewed the <br />role and purpose of the Variance Board. <br /> <br />2. <br />Roll Call & Introductions <br />City Planner Thomas Paschke called the Roll. <br />Members Present: Chair Daniel Boerigter and Commissioner Jim Doherty. <br />Members Absent: Commissioner Andre Best. <br />Staff present: City Planner Thomas Paschke; Associate Planner Bryan Lloyd; and Economic <br />Development Associate Jamie Radel. <br /> <br />3. <br />Review of Minutes <br />MOTION <br />Member Doherty moved, seconded by Member Boerigter, to approve meeting minutes of <br />September 3, 2008 as presented. <br />Ayes: 2 <br />Nays: 0 <br />Motion carried. <br /> <br />4. <br />Public Hearings <br />a. PLANNING FILE 08-040: Request by Joan Lasser, 3012 Old Highway 8, for a <br />VARIANCE to City Code, Section 1012 (General Requirements) to allow a privacy <br />fence to extend into the required front yard. <br />Chair Boerigter opened the Public Hearing for Planning File 08-040. <br />Associate Planner Bryan Lloyd reviewed staff’s analysis of the request to allow <br />construction of a 6.5 foot-tall fence extending in front of the principal structure. Mr. Lloyd <br />advised that Mrs. Lasser was seeking increased privacy and security prompted by a <br />multi-family facility (Talia Place Apartments) abutting the subject side property line, and <br />allowing adequate screening of the parking area from her home and yard. <br />Mr. Lloyd noted that per code, the maximum height for a fence in a front yard was four <br />feet (4’); and that fencing for side yards and/or rear yards was indicated at a maximum of <br />six and one-half feet (6-1/2’). Mr. Lloyd noted that a variance for additional height for a <br />fence in the front yard would serve to screen parking and a dumpster from the adjoining <br />multi-family building. <br />Mr. Lloyd advised that the City’s Code Enforcement Officer had attempted to work with <br />the multi-family property owner to accommodate the dumpster on their property, rather <br />than on public right-of-way. Mr. Lloyd noted that the options on the property itself were <br />limited as the building setbacks were minimal, and various dumpster locations blocked <br />tenant windows. <br />Mr. Lloyd advised that, as per the project report, staff was recommending that the <br />property owner be allowed to proceed with the additional height fence up to the front <br />property line to facilitate screening of the parking and dumpster. <br />Mr. Lloyd advised that staff was further recommending a condition that the existing <br />driveway area, used for parking a recreational vehicle and less than five feet (5’) from the <br />southern property line, be removed and that area planted with grass or otherwise <br />landscaped; to comply with City Code requirements. <br /> <br />
