Variance Board Meeting <br />Minutes - Wednesday, October 01, 2008 <br />Page 2 <br /> <br />Staff recommended APPROVAL of a 2.5 foot VARIANCE to the maximum height of a <br />fence in a front yard, established in City Code, Section 1012.02B(2) (Legal <br />Encroachments), to allow the installation of a privacy fence on the residential property at <br />3012 Old Highway 8; based on comments and findings outlined in Section 5, and <br />conditions detailed in Section 6 of the staff report dated October 1, 2008. <br />Discussion included staff’s recommendation for allowing the fence to go all the way to the <br />front property line; and requiring relocation of the dumpster for the apartment complex by <br />staff intervention, rather than requested by the applicant. <br />City Planner Thomas Paschke advised that staff was in the process of working with the <br />multi-family complex property owner for removal of the dumpster from the public right-of- <br />way, and in assisting them in finding an appropriate spot on their private property. Mr. <br />Paschke advised that this property was subject to pre-existing conditions that pre-dated <br />requirements of the City Code requiring dumpster enclosures; and noted that the multi- <br />family property was developed from property line to property line. Mr. Paschke advised <br />that staff would continue their efforts with the multi-unit property owner. <br />Applicant, Joan Lasser, 3012 Old Highway 8 <br />Mrs. Lasser reviewed her written request for a fence height variance, and previous <br />attempts to grow a natural barrier (lilac hedge); and highlighted ongoing problems with <br />renters in the apartments and unleashed pets and vehicular trespassing onto her yard. <br />Mrs. Lasser asked that the condition removing the driveway area be eliminated, noting <br />that the motor home had already been removed, but opining that the bituminous in that <br />area would be difficult to remove and had been there when they moved into the home. <br />Further discussion included impervious coverage calculations being well below <br />requirements; the applicant’s intent to place 102’ of fencing along the front area in <br />question. <br />Chair Boerigter closed the Public Hearing, with no one appearing for or against. <br />Commissioner Doherty spoke in support of the Variance request, excluding the condition <br />for removing a portion of the driveway area; questioning what that accomplished. <br />Chair Boerigter spoke in support of the request; also excluding Condition C related to <br />removal of a portion of the driveway. <br />MOTION <br />Member Boerigter moved, seconded by Member Doherty to APPROVE Variance <br />Board Resolution No. 83 entitled, “A Resolution APPROVING a VARIANCE to <br />Roseville City Code, Section 1012 (General Requirements) for Joan Lasser, 3012 <br />Old Highway 8 (PF08-040);” to allow a privacy fence to extend into the required <br />front yard; based on the comments and findings of Section 5 and the conditions of <br />Section 6 of the project report dated October 1, 2008; <br />amended to strike Condition <br />C as recommended in the project report, Section 6.0. <br />Ayes: 2 <br />Nays: 0 <br />Motion carried. <br />Chair Boerigter reviewed the appeal process. <br /> <br />5. <br />Adjournment <br />Chair Boerigter adjourned the meeting at approximately 5:47p.m. <br />
