Regular City Council Meeting <br />Monday, November 17, 2008 <br />Page 6 <br />(i.e., public notices and publications) and billable hours quantified for each appli- <br />cation throughout the process that would be deducted from the escrow. <br />City Attorney Squires noted the billable hours for staff identified in the fee sched- <br />ule (zoning compliance letter section); and suggested that language be included in <br />the ordinance and attached fee schedule granting staff authority to charge back <br />staff time. <br />Further discussion included new construction on existing streets versus repairs <br />(Page 2, line 63) and staff s rationale for only billing repairs, since new develop- <br />ments or new construction would typically have a contractor available to com- <br />plete the work. Mr. Schwartz noted that it was staff's intent only to control the <br />quality of street patches and to offset costs or to provide them at cost to home- <br />owners experiencing unexpected street repairs. <br />Additional discussion included off-sale liquor license fees and their increase from <br />$200 to $300, more accurately reflecting staff's actual time for review of applica- <br />tion materials and performing criminal background checks and bringing them <br />forward for City Council action; and the maximum amount allowed by state law <br />being $300.00, while actual City costs exceed that amount slightly. <br />Councilmember Pust suggested staff review the City's current election filing fee <br />of $5.00, for future recommendation, and whether that would fall under a regula- <br />tory type fee. Councilmember Pust further noted that the City's Leaf Pick Up Fee <br />had not changed, and that at $25 per participant, the City was still subsidizing the <br />program and questioned why this fee was not recommended for increase. <br />Mr. Miller advised that the fees had increased several times in the past, and at <br />each increase the level of participation had dropped; and noted past City Council <br />discussions and costs incurred for sweeping streets, while continuing to subsidize <br />the leaf pick up program. <br />Mr. Schwartz advised that it was staff's intent to do further evaluation of the pro- <br />gram this year, and noted that a significant difference in staff time for cleaning <br />gutters versus registered leaf pile pick-up had been noted this year; and advised <br />that he anticipated additional data for which to substantiate a potential proposed <br />increase in the leaf pick up program for 2010 following that evaluation. <br />Klausing moved, Roe seconded, enactment of Ordinance No. 1379 entitled, "An <br />Ordinance Adopting the 2009 Fee Schedule," as detailed in Ordinance Attach- <br />ment Aentitled, "2009 Fee Schedule effective January 1, 2009;" amended to up- <br />date the escrow language as per discussion and at the direction of the City Attor- <br />ney (page 13, Community Development Department and their authority to charge <br />back staff time to applicants for Planned Unit Developments and Subdivisions). <br />
