Article 1: PREMISES: <br />(a) Demise. �andlord heref�y demises and leases to Tenant and Tenant hereby rents and <br />takes from Landlord t�e Premises, for the Term and subject to and with the be�efit of the <br />terrt�s, covenants, conditions and provisions of this Lease. Tenant snall permit Landlord (or <br />its designees) to erect, use, maintain, replace ar�d repair �ipes, cabfes, conduits, plumbing, <br />vents, and telephone, electric and other wires or other items, in, to and through the <br />Premises, as and to the extent that Landlord may now or h�reafter deem necessary or <br />a�propriate for the �roper operation and maintenar�ce of the Shopping Center, provided <br />that any such activity does not interfere with Tenant's use of the premises for its permitt�d <br />use. <br />{�} Common A�eas. The use and occ�pancy by Tenant of the Premises sl�all include the <br />reasonable non-exclusive use in corr�man with others entitleci thereto of the parking areas, <br />service roads, loading facilities, sidewalks, landscaped areas, res�roorns and aC1�er carrtmon <br />areas so designated f�y Landlord with the Shopping Cenrer. Landlorcf shall at aEl times hav� <br />€ull contral, management and direction of the Shopping Center suf�ject �o the rights of <br />Tenant in the Premises, and Landlarc! reserves the right at any time and from time to time <br />tfl reduce, increase, encfase or ot�erwise change the size, number and location of buiidings, <br />layout and nature of the Shopping Center anci t�e oCl��r tenancies, premises and buildings <br />included in the St�op�ir�g Center, to construcC additi�nai buifdings and additions to any <br />building, to increase the size of the Shopping Center by adding parcels of land t� the <br />Shopping Center and to creafie additianal rentable areas includable in the 5hopping Cer�t�r <br />Tract tf�rougi� use and/or er�ciosure of cornr�on ar�as ar otherwise, and to �lace signs on <br />the Shop�ing Center and to change the name, address, number ar designation by which the <br />Shopp[ng Center is cammonly known. �andlord shafl #�ave the exclusi�e right to use all or any <br />part of the roof over the Premises and exteriar walls of the Premises �or any purpose; to <br />erect in cor�nectiort with the construction thereof temporary 5caffalds anc! other aids to <br />construction an �he exterior af the Premises, pro�ided that access to the Premises shalf not <br />be irnpaired. In addition ta the foregoing, Lanc�lord may make any use it cfesires of the side <br />and rear walls of the Prerr�ises, pro�ided that there s�all be na encroachment upon the <br />irtterior of the Premises and provided further that the Ter�ant's access to the Premises shall <br />not be impaired. <br />(c} Permitted l�se. <br />{i) The Prernises shall only be used for the Permitted Use and for no other business or <br />purpos� without t�e �rior written consent of Landlordr WF1ECEl shaff r�ot be unreasonably <br />withheld by Landlord. Tenant shall not commi� or allow to be committecl any waste upon <br />the Prernises, or any puf�fic �r private nuisance ar other act or thing which disturbs the <br />tenancy of any other tenant in the Building or which cauld injur� t�te repu�a�ion of the BuiEding <br />or is unfawfuf, or a vio�at€on of applicabfe zoning laws or ardinances or �ase restrietion. <br />Landlord shall ha�e the right to granr exclusive rights to parties in the Shopping Center to <br />conduct any particular business or undertaking therein. Tenar�t shall not abandon or vacaie <br />the Premises during the �erm. <br />3 <br />
