(ii} �'enant agrees to I<eep its Prer-r�ises adequately illuminated and continUOUSIy and <br />generally open for business duri�g the I�ours of 9:04 a.rr-i. ta 5:00 p.m. Monday through <br />Friday (excluding holidays), and shall maintain therein a substantia] stack of ine�cha�dise ancf <br />sufficient numb�r of er3-rployees for the pur�ose of selling said merchandise, �nless preventecE <br />from doing so by stril<es, fire, casuaities or other causes f�eyond Tenant's control. <br />Article 2: LEASE COMMENCEMENT AND EXPIRATION DATE <br />(a) Delivery Date. The Delivery Date of t�e Term shall be the later of the date specified in <br />the DATA SHEET ar, if the Building and the Lar�dlord's Improvemen�s have not been <br />completed prior to the executian t�ereo�, the date the Premises are r�ady for Tenant's <br />beneficial occupancy or for performance af Ter�ant's Work, as specified in a notice defivered <br />to Tenant at feast 5 days prior to the Delivery Date. If the Delivery Date is established as a <br />later date tt�an the Deli�ery Date speeified in the DATA SHEET, Land�ord shal� cor�firm such <br />date to Tenant in writir�g. <br />(b} Delayed or Early Occupancy. If �.andiord is unable to give possession of the Premises <br />within � 5 days of the Delivery Date set fortF� in the DATA SHEET because th� constructior� o� <br />the Shopping Center or constructio� of �andlord's Work in t1�e Premises has not been <br />sufficfently completed to mal<e the Premises ready for �"enant's Work, or for any other <br />r�ason, Tenant shall have the right at its optian to terminate the Lease. If Tenant does not <br />tierminate the Lease, Ter�ant's obEigation to pay Rent shall not commence until possession of <br />the Premises is gi�en and (i) �enant has l�ad thirty (30} days to compleCe Tenant's Work or <br />(ii) the Premises are a�en �or busir�ess, whichever is earlier, and fa:lure to give possession on <br />the Delivery Date set forth in the DATA S�IEET shall in no way affect the validity of this Lease <br />or th� obfigations of Tenar�t hereunc�er, r�or f�e canstrued in any way to extent the Expiration <br />Date o� the Term. If T�nant is giver� and accepts possession of the Premises on a date <br />earlier than the Delivery Date set farth in the DATA SNEE�, the Rent reserved herein and ali <br />cavenants, agreements and obfigations herein and the term of this Lease shall commence on <br />the earlier of (i} the Comrnencemen� Date or {ii) tl�e date Tenant opens for f�usiness in the <br />Premises, but in no event shall the Expiration Date be deemec� modified as a result thereof. <br />Upon establishment of th� Commencement �ate, Landlord shall confirm said date to Tenant <br />in writing. . <br />(c) Accepta�ce of Premises. If this Lease is entered into prior to the substantiai <br />compietion of construction of the Buifding or substantial comple�ion af Landlord's Work in the <br />Premises, Tenant shall notify Landlard in writing within fifteen days after the Delivery Date of <br />any defects or deficiencies found in the Premises after Tenant has made such inspection of <br />the Premises as Tenant deems appropriate. ExcepC as Tenant shall otherwise notify <br />�andlord within such fifteer� day periad, Tenant shall be deemed to have accepted the <br />Premises in �heir condition "as is" at that tim�. 1f as a result of such inspection Tenant <br />discavers minar deviations ar variati�ns frorr� tt�e plans and specificatEOns far Landlard's <br />Work o€ a nature commor�ly found ari a"punch list" {as that terrr� is used in the construction <br />industry), Tenant shall rtotify �andlord in writing of such de�iations within such fifteen day <br />period. �andlord shafl repa€r actua! deviations witl�in a reasonable time. The existence ofi <br />such punch fist items shall not postpane the Delivery Date, the Commencement Date nor the <br />6� <br />
