Attachment B <br />Regular City Coancil Meeting <br />Monday, September 22, 200$ <br />Page 5 <br />A bench handaut was provided with additional detail via e-mail from Ms. Sue <br />Shea, Past Pr�sident of the 'Westwood Village I Ass�ciation regarding steps taken <br />by the Association to ensure future financial stability of the Associa�ion to avaid <br />similar siivations. <br />As detailed in the siaff report, Section 3.9, N1s. Kelsey noted that a second public <br />hearing would be scheduled in the future to discuss the cost of the project and the <br />amounts to be assessed against each unit, with requested Council actron at that <br />time in the form of a res�lution assessing those costs prior to the pro�ect being ini- <br />tiated. Ms. Kelsey noted that there would be oppartunity far residents to pay off <br />t�e assessment without finance charges or fees; in accordance with the Associa- <br />tion's Second ArnendmenE Declaration for esiablishing assessment amounts, basi- <br />cally dividing costs equally among the 47 homeowners. <br />Ms. Kelsey reviewed the praposed ordinance establishing a housing itnprovement <br />�rea (HIA) t�ati would, upon ena�tment of t�e �ity Council, take place 45 days <br />thereafter; and that during that time period, owners af at Ieast 35% of �k�e units, or <br />in this case, 17 units, could veto the ordinance by filing a petition of objection. <br />Ms. Kelsey reviewed, as per Section 3.10 of the sta�f report, other communities <br />having established HIA's in the past, and their experiences in doing sa. As part of <br />their analysis, staff'recommended a 15)year t�rm, with a 1.5% administrative fee <br />over and above the assessment amount of the improvements, using the Second <br />Amended Declaration of Common Interest Community No. 727, a Planned Com- <br />munify — Westwood Village, d`stributing assessments equally among the 47 <br />homeowners.. <br />Ms. Kelsey provi�ed; in addition to written festimony provided in the staff report, <br />three additional wri�ten testimonials sup�drting the requested City Council action. <br />Ms. Kelsey concluded by r�viewing regiiesied Council action tonight, in opening <br />the Fubiic Hearing ta fiake public comment; noting that mailed notic� was sent to- <br />ta1 owners of record within the proposed boundary of the HIA for 'UVestwood Vil- <br />lage I, in additio� to published notice in the Roseville Review. �vls. Kelsey noted <br />that the current and past presidents af the Association Board were present and <br />�vould �ike fo spea�C �o the issue prior to public �o�nmenf. <br />NYark Isindberg, current President, West�vood Vi�lage I; [2702j MacKubin <br />�treet <br />N�r. T,indberg read a prepared statement, providing a history of the praject, current <br />deteriorat�on of the buildings, lack of foresight in origrnal governing documentis <br />from the 1960's for this major of a project, inadequate Associa�ion funds, and the <br />Association's desire to� partner with the City to accomplish this rehabilitaiion.
