Councilrriember Fust opined that <br />the City Council served the community better by taking action anc� protecting <br />the�n in the market place. <br />Further discussian ensued regarding interpretation of the he�ring process and ac- <br />tions; s�parate action in establis�ing an HIA, and a second process in dete�rrr�ining <br />and assessir�g a portion of the costs, consistent with State Statute and a two-tier <br />pracess, as� outline�d by City Attorney Squires. <br />Klausing moved, Pust seco�ded, enactment of Ordinance No. 1377 enfitled, "An <br />Ordinance EstablishEng a Housing Improvement Area (HIA) far the Westwoad <br />Villag� I Townho�uses, pursuant to Nlinnesota Statutes, Chapter 428A;" amended <br />as follows: <br />Pa e 1 Section 1 of the Now therefore ... r�vis� wordin as fol�ows: <br />"Pursuant to Minnesofa Statutes, Chapter 428A, there is hereby establishec� in the <br />City of i�oseville a hausing improvement area over property commonly known as <br />Westwood Village I To�vnhouses. [For the] purpose of this Ordinance, [the] CiCy <br />shall be the implernenting Agency." <br />and <br />Page 2, Section 5, Housing Iinprovernent Fee. Subd. A— Strike the entire section <br />identi�ied as "a" and re-Ietter the remaini�ig four (4) items: a; b, c, and d. <br />Councilmember Roe spoke in suppart of the ordinance as amended. <br />Cauncilmember IhIan spoke in support of the ordinance as amended; however, <br />requeste�d tha� the City Council hold a real discus�sion about t%e fairness of rhe <br />propased cost allocation to the six smaller units; and for the record, opined the <br />need for additional due diligence in the future, through provision by staff of addi- <br />tional docurnents and information ta perform that due diligence. <br />Ro�l CaII <br />Ayes: Rae; Ihlan; Willmus; Pust; and Klausing. <br />Nays: None. <br />12.
