The Baard, or the appoint�d <br />architectural cornmittee if so authorized by the Board, shall be the sale <br />judge of whe�er suc� criteria are satisfied, and its determination in this <br />regard sha�l be binding upon the Owner.. <br />$.1.4 Approval of alterations whic�i cause a minor encroaahment upon <br />the Corivnon Elements or anather Unit shall create an appurtenant <br />easement fcsr such encroachment in �avor of �l�e Unit with respect ta which <br />the aIterations are approved, notwithstanding any contrary requirement in <br />the Governing llocuxnents ar the Act. A file of the Baard resolutions <br />agproving or cienying all req�iesfis for altera�ions s�all �e rr�aintained <br />permanently as a part of the Association's records. <br />8.2 Review Procedures. The £ollowing procedures shall govern requests for <br />alterations under this Section: <br />8,2.1 Detailed p�ans, specifications and related infomiation regarding <br />any proposed alteration, in forrn and content aeceptable to the Board, shali be <br />subrnitted to the Board at least si��ty days prior to the projected cornmencement af <br />construct�on. No alteratians s1�aI1 be commenced prior ta approval. <br />8.2.2 Tl�e Board sha11 give �e Owner written notice of approval or <br />disapproval. The Board sha�l have the right and autho�ity �o approve, <br />conditionally approve or deny zequests for alterations in its sole and absolute <br />discretion. If the Boa.rd fails to approve or disapprove wit7iixi sixiy days af�er <br />receipt af said plans and specifications and alI o�er infarmation requested by the <br />Board, then approval shall be deemed ta be denied. <br />8.23 If no request for approval is submitted, approval sl�all be deemed <br />to be denied. <br />8.3 Remedies for Violations. The Association may undertake any rneasures, <br />Iegal, eqt�.itable or ad3ninistrative, to enforce compliance with ihis Section aud shall be <br />entitled to recover from the Owazer cat�sing or permitting the violation all attorneys' fees <br />and other professional fees and costs of evaivatian, investigatian and enforcernent <br />in.curred by the Assaciation, whether or not a legal aetion is st�ted. Such fees and eosts <br />sha11 be a 1'ren agair�st t.�e Owner's Unit and a personal obligation of the 4vvner. rn <br />addition, upan reasanable notice, the Assaciat�an sha11 have the right to enter the <br />O�vner's Unit a3nd to resEore any paxt of the Dwelling or Unit to its prior condition if Yhe <br />alterations were macle in viola�ion of this Section, and the east of such restora�ion shall be <br />a personaL obligativn of the Owner and a lien agair�st Lfte Owner's Unit. <br />8.4 Owner Responsibili�ty/Indernnity. The Owner wha causes an alteratian to <br />be made, rega.rd�ess o£ whether the aiteration is appzaved by the Board, shall be <br />responsii�Ie far the construction work and any claims, damages, losses or liabiiities <br />� <br />
