Tenant shaEl permiE Landfard (or <br />iis designees) ta erect, use, maintain, replace and repair Pipes, cabEes, conduits, plumbing, <br />vents, and tel�phone, electric and other wires or othe.r irtems, in, to and through the <br />Premises, as and to the extent ti�at Landlord may now or hereafter deem necessary or <br />appropriate f�r the �raper o�eration arid maintenai�ce of the Sh.o�ping Center, provid�d <br />that any such acti�ity does not interfere with Tenant's use of the prerr:ises for its permitted <br />use. <br />(b) Comman Areas. The use and occ�spancy €�y Tenant af the Premises shall ir�clude the <br />reasonable nan-exclusive use in comi�non with others entiC�ed �i��reto of the parking areas, <br />service roads, loacfing facilities, sidewalks, landscaped areas, restroorns and a�her cammon <br />areas so des[gnated f�y Lanc�lord with the Sha�ping Cen�er. Landlar� �hail a€ alf times have <br />full control; mana�em�nt and direction of the Shopping Genter subject to the rights o€ <br />Tenant in the Premises, and Landlord reserves the right a� any time and €rom time ta time <br />to reduce, rncrease, enctose or otherwise change the size, nurnber and locatian of buildings, <br />layout and n�ture of the Shop�ing Center and the other t�nancies, prerr�ises and buildings <br />included in the Shopping Center, to canstruct adciitianal b�i�dings and additi�ns ta any <br />building, to increase the s;ze af the 5hopping Center by adding parcels of land ta the <br />Shopping Center and ta cr�ate additianal rentable areas iricludabfe in the Shopping Cent�r <br />Tract tiiroug�t use and/or enclosure of comrr�on areas ar athe.rwise, and ta plac� signs on <br />the Shop�ing Center and to cf�ange the name, address, n�rr�ber ar desig�at.ion by which th.�. <br />Shopping Center is corramonly �nown. Landlord shaff have the exc�usive r�g�t to u:se afl or any <br />part of the roof over the Premises and exteriar walfs of the Premises for any purpose, to <br />erect in conn�ctian with the cons�ruction thereof temporary scaffol.ds a.nd othe� aids to <br />constructian on the exterior of the Premise�; pravided that accESS to �he Premises shalf not <br />be impaired.. in addition ta the �oregoing, La�dlorc� may make any use it desires a� the side <br />arid rear walls of the Prernises, providec3 that there s�all: be no encroachment. upon the <br />interior of tne Prerr�fs�s and provided furth�r that the €enant`s access to the Premises shall <br />not be impairecl. <br />(c} Permitted Use. <br />(i) T�e Prei�iises shail or�ly be us�d for the F'errnitted Use and �or no o�her business or <br />purpas� wiEhout t�se prior written consent af Landlord, which shall not �e unreaso�abiy <br />withheld by Landlo�d. Tenant shall �ot. cammit or allaw to be com�-r€itted any waste upon <br />the Premises, or any pubGc ar private nt�isance or other act or t#�ing which disturbs the <br />tenancy of any otf�er tenan� in the Building or whic}� cauld injure th� re�u�ation n� the Buifding <br />or is unlaw�ul, or a viota�ion of ap�lie2bfe zoning laws or a�dinances ar� use �estriction. <br />Landlard s�all have i�se right to grant exclusiv� rights to parties in rhe Shopping Center to <br />conduct any �artic�la� business or un�ertaking therein.
