Department Approval <br />� <br />Item Description: <br />l�'�, <br />Jy <br />REQUEST FOR COUNCIL ACTION <br />Date: 3/9/09 <br />Item No.: 7.g <br />City Manager Approval <br />� / <br />Contract to Prepare a Response Action Plan for the Twin Lakes AUAR Subarea I <br />Infrastructure Improvements <br />BACKGROUND <br />On June 9, 2008, the City Council approved a contract with WSS & Associates to complete the design <br />work for the Twin Lakes AUAR Subarea I Infrastructure Improvements. These include: <br />• Intersection improvements at County Road C and Cleveland Avenue <br />• Cleveland Ave / I35W ramp and intersection improvements <br />• Intersection improvements at Fairview and Terrace Drive <br />• Twin Lakes Parkway from Cleveland Ave. to Fairview Ave <br />• Mount Ridge Road from County Road C2 to Twin Lakes Parkway <br />• Prior Avenue south of Twin Lakes Parkway to County Road C <br />• Municipal utilities including sanitary sewer, water, and stormwater. <br />� The scope of services for the geotechnical investigation and environmental investigation was undefined <br />� at the time of the approval of the contract with WSS. The contract not to exceed cost, $458,036.00, did <br />� not include the fees for environmental work. As described in Section 4.10 of the contract, WSS has <br />� teamed with Sraun Intertec to perform geotechnical and environmental investigations where needed <br />� within the right- of- way. On October 20, 2008, the City Council amended the contract with WSS to <br />� include the geotechnical and environmental investigations. These investigations consisted of soil <br />� borings within the proposed right- of- way. The soil borings have characterized the types of <br />� contamination within the project right- of- way. <br />, In order to move forward with the construction of the public improvements, Sraun Intertec needs to <br />, prepare a response action plan (RAP) to provide for the appropriate management of petroleum and non- <br />� petroleum contaminated soil and groundwater that is expected to be encountered. The RAP will be <br />� submitted for review and approval to both voluntary programs within the MPCA; the Voluntary <br />, Investigation and Cleanup (VIC) program, which manages non-petroleum contamination, and the <br />, Petroleum Srownfields (PS) Program, which manages petroleum- related contamination. As a part of <br />� this contract amendment, Sraun Intertec will assist the City in preparing an enrollment application for <br />, MPCA VIC and PS Programs. <br />� POLICY OBJECTIVE <br />� Since the preparation of the response action plan requires professional service contracts, the City <br />Council is being asked to authorize the City Manager to execute this agreement amendment. <br />Page 1 of 2 <br />
