Approve Community Development Department Request to Issue a Ramsey <br />County Court Citation for Unresolved Violations of City Code at 648 Iona <br />Lane <br />Community Development Director Patrick Trudgeon provided Councilmembers <br />with a narrative and photographical update on the subject property since the origi- <br />nal public nuisance was sent out in June of 2008; ongoing discussion with the <br />property owner(s); and recent activities of the property owner to resolve remain- <br />ing issues, based on repeated re-inspections by staff. Mr. Trudgeon noted that the <br />most recent re-inspection by staff was done on May 18, and May 26, 2009, and <br />that this had apparently prompted the property owner, upon receipt to the property <br />owner of tonight's Request for Council Action. Mr. Trudgeon advised that staff <br />could no longer provide abatement of the remaining issues, since the siding had <br />been removed from a major portion of the home by the property owner(s). Mr. <br />Trudgeon noted that staff was reassured by the progress being made by the prop- <br />erty owner; however, sought authority from the City Council for issuing a Cita- <br />tion if the owner did not complete the work in a timely manner, based on past de- <br />lays experienced. Mr. Trudgeon assured Councilmembers that, prior to filing the <br />Citation with Ramsey County, staff would make a final inspection for compli- <br />ance; and if the work had been completed, would not file the Citation. <br />Discussion included staff timing for preparation of the Citation; the process itself <br />with a Preliminary Hearing by Ramsey County; and intent of the property owner. <br />Property owner representative; son of Manzoor and Mahroof Moghul <br />The property owner's son provided Councilmembers with their receipt of notice <br />of tonight's proposed action and their work prior to that notice (including new <br />windows and purchase of siding). Discussion included storage of the materials <br />off-site and their subsequent theft; lack of funds to repurchase replacement siding; <br />and their intent to complete the project as soon as possible. The property owner's <br />son requested a delay in issuing the Citation to allow them to complete the work <br />within the next few days, weather allowing.. <br />The property owner was assured that if they continued to work at their current <br />rate, they could be able to finish the work and avoid the Citation; but that the City <br />Council would ask to authorize staff to issue a Citation to ensure that the property <br />owner remained motivated and continued to pursue completion and realize the se- <br />riousness of the situation. <br />The Moghul's son promised Councilmembers and staff that the work would be <br />completed. <br />Johnson moved, Pust seconded, directing staff to proceed with issuance of a Ram- <br />sey County Court Citation to the property owner of 648 Iona Lane to ensure <br />abatement of remaining City Code violations and public nuisances, as detailed in <br />the Request for Council Action dated June 8, 2009. <br />
