Driveway Setback Ieviation• A driveway setback deviation is a reduction of the side yard <br />setback required m subsection 703 04B of this code <br />a._ A driveway setback deviation Shall not allow encroachments into the required setback <br />from corner side propert lines <br />b. If a driveway setback deviation is necessitated by a public improvementproject or any <br />other public action and a driveway is not closer than two (2) feet from an interior side <br />property line, the Community Development Director or desi nee may approve the deviation <br />without adherma to the procedure described in subsection B of this section <br />c. A driveway setback deviation shall not reduce the required setback of a driveway <br />more than sixty percent (60%) or allow a driveway to be closer than two (2) feet to an <br />interior side propert line. <br />3. Impervious Coverage Deviation• An impervious coverage deviation is an increase in the <br />amount of impervious surface area allowed in either K-1 or R-2 districts <br />a. An impervious coverage deviation shall not allow impervious coverage on any_pro~erty <br />to exceed code allowances by more than 20% <br />b. An application for impervious coverage deviation shall be sup o~rted by a preliminary <br />storm water runoff mitigation plan; the preliminat mitigation plan shall p opose measures of <br />reducma storm water runoff from the property to the level that is consistent with the <br />maximum imprrvious coverage allowed by the code <br />(1) Anv necessary building or driveway permit(s) shall not be issued until a storm water <br />runoff mitigation plan has been approved by the City Engineer <br />(2) Implementation of the storm water runoff mitigation plan shall be completed as a <br />necessary condition for passing the final building or drivewa inspection <br />l~C. Procedure For c°*'-~~'~ n°~~* Administrative Deviation: An owner of land m~-shall file an <br />application for°*'~~°'- r°~~* a ~' a ' '- *' - ~ ~ ~*~' *' an administrative <br />r ~ <br />deviation by paying the fee set forth in section 1014.03 of this title and providing a completed <br />application and supporting documents as set forth by the community development department. <br />~ianc~ <br />~~ ~~ <br />
