' > <br />. 41.Notification: The community development director for designee3 shall schedule an <br />administrative hearing before the development review committee, tl'° +?me "~a --~ ~ ~-• '- <br />• to consider the application. <br />The applicant and contiguous property owners shall be notified in writing by the community <br />development director for designees of s~e4rthe time and place of the administrative hearing ~ <br />irignot less than five (5) days prior to such hearing. The community development director <br />for designees may inform additional property owners if a determination is made that such <br />additional notification is merited. All property owners receiving notification of the administrative <br />hearing shall be invited. to comment on the pro posed project and/or to attend the hearing <br />2. Review of Application: During the administrative hearing described above the development <br />review committee shall review applications for administrative deviation and rovide <br />recommendations ertainin to the a royal or denial of the re uest• the cotnmunit <br />development director or designee may request additional review of applications from other citX <br />departments or public agencies <br />3. Decision.: After considerinU the public input and the recommendations ofthe above arties <br />the communrty development director or designee shall have the authority to approve or deny <br />admimstrative deviation applications <br />4. Appeal: No permits may be issued for a project requiring an administrative deviation before <br />the expiration of a mandatory ten (10) damappeal period begimling on the date of the decision of <br />the community development director or designee• notwithstanding the following provisions <br />appeals of this decision shall adhere to the process established in section 1014 04C oi'this code <br />• a. Appeals may be made by the on ig nal applicant or those property owners identified <br />pursuant to subsection C 1 of this section as receiving notification of the administrative <br />hearin~• <br />b. If all. of those property owners identified pursuant to subsection C1 of this section as <br />receiving notification of the administrative hearing indicate to the community development <br />director or designee that they will not appeal the decision the appeal period may be waived <br />D. Necessary Criteria For Approval <br />~1.Structure Setback Deviation: In addition to other requirements of this section, the <br />development review committee in r~xnmandine ~n~,rnv ~ ~' +i. 1 •+ 1, 11 ~ a ..t . <br />~ b YY '+'~' ~ <br />• • prior to recommending <br />approval or denial of a structure setback deviation shall consider the followin factors: <br />a The proposed project improves the functional use of the property; <br />b. The proposed project improves the enclosed storage on the property <br />c. The proposed project does not create or exacerbate a drainage problem• <br />d. The final building mass is consistent with that on Conti uous p~erties• <br />e. The new roof is properly proportioned to and integrated with the existing roof of the <br />~rmcipal structure on the property <br />f.
