If the City is relocating Facilities before the Contractor <br />3 begins construction, the City must work with the Project Engineer to determine if <br />4 pollution control measures are necessary and how to implement them if they <br />s are. <br />6 <br />7 2) Pursuant to Minnesota Statutes, section 115.07, and Minnesota Rules, part <br />8 7001.1030, the City must submit the plans and specifications for sanitary sewer <br />9 construction or reconstruction to the Minnesota Pollution Control Agency <br />io (MPCA). The City must obtain the necessary permit or waiver from the MPCA <br />11 before performing the construction or reconstruction. Minnesota Rules, part <br />~2 7001.1040 requires the City to submit a written application for the permit or <br />t3 waiver at least 180 days before the date planned for commencing the sanitary <br />i4 sewer facility construction or reconstruction. <br />IS <br />~6 I11. City's Ongoing Maintenance Requirements <br />17 <br />18 A) Once construction is complete, the City must maintain the Facilities at its own expense. <br />19 The City must follow the terms of the permit when it performs any maintenance work. <br />20 <br />2t B) The City may open and disturb the trunk highway right of way without a permit in the <br />22 case of an emergency that is dangerous to the public and requires immediate <br />23 attention. Upon learning of an emergency, the City must immediately notify the State <br />24 Patrol. The City must take all necessary and reasonable safety measures to protect <br />25 the public and must cooperate fully with the State Patrol. In this event, the City must <br />26 request a permit from the proper authority no later than the working day after it begins <br />27 working in the right of way. <br />28 <br />29 IV. Property Rights <br />30 <br />3~ A) The City must convey, by Quitclaim Deed, its right, title, and interest in property located <br />32 in Ramsey County, Minnesota to the State. This property is legally described as: <br />33 That Part of the City's Easement No. 1533923 over, under and across the Northwest <br />34 Quarter of the Northwest Quarter of Section 17, Township 29 North, Range 23 West <br />35 which lies westerly of the east right of way of T.H. 280 and will be described further in <br />36 the Quitclaim Deed. <br />37 <br />38 <br />39 <br />Page5of11 <br />
