The City must restore all drainage and <br />3 slopes to the Project Engineer's satisfaction. <br />4 <br />5 7) Report the work it performs each day to the Project Engineer on the State's <br />6 Daily Utility Report, Form 21191, or on another form that the State deems <br />~ acceptable. The City must submit this report to the Project Engineer no later <br />s than the day after performing the work. <br />9 <br />l0 8) Maintain accurate and up-to-date relocation cost records throughout the course <br />11 of the Project. <br />12 <br />13 9) Leave materials in place at the Project Engineer's discretion. Any materials left <br />14 within the highway right of way after the City completes its work will become the <br />15 property of the Contractor. <br />16 <br />17 10) Acquire all necessary replacement right of way. <br />18 <br />19 B) Compliance with Safety Regulations <br />20 <br />21 1) The City must comply with the safety regulations contained in Minnesota Rules, <br />22 part 8810.3300, subpart 5, during all construction and maintenance operations. <br />23 The City will furnish and require each flagger to carry a copy of the current <br />24 edition of the State's Field Manual, which is Part IV of the Minnesota Manual of <br />25 Uniform Traffic Control Devices. The City must furnish each flagger with the <br />26 required vest, hat, hand sign, flags, and any other necessary safety equipment. <br />27 <br />28 2) The provisions of this Agreement do not relieve the City of any legal <br />29 responsibility or liability associated with the construction, operation, or <br />3o maintenance of its Facilities. <br />31 <br />32 C) Compliance with Pollution Control Requirements <br />33 <br />34 1) The Contractor installs pollution control measures according to the National <br />35 Pollution Discharge Elimination System permit (NPDES permit). Pollution <br />36 control measures include silt fences, slope stabilization measures such as seed <br />37 and mulch, and any other measures the State deems necessary to comply with <br />3s the NPDES permit. If the City's work affects such pollution control measures, <br />39 the City must restore them to their original condition and to the Project <br />Page 4 of 11 <br />
