4.O BACKGROUND <br />� 4.1 The property at 2205 County Road C2 has a Comprehensive Plan designation of <br />� Industrial (I) and a zoning classification of General Industrial (I-2) District. <br />� 4.2 This coNDiT1oNAL usE proposal has been prompted by the applicant's desire to sell light- <br />� duty cargo trailers. Despite the absence of specific recognition of trailers in Roseville's <br />City Code, Minnesota law defines them as a type of vehicle. <br />5.O STAFF COMMENTS <br />� 5.1 While trailers are not technically motor vehicles, MN Statute 169.011 subd. 86 defines <br />� trailers as "any vehicle designed for carrying property or passengers on its own structure <br />� and for being drawn by a motor vehicle but does not include a trailer drawn by a truck- <br />� tractor semitrailer combination or an auxiliary aYle on a motor vehicle which carries a <br />_ portion of the weight of the motor vehicle to which it is attached. " Sased on the <br />_ association in State Statute between motor vehicles and trailers, Community <br />_ Development staff has determined that it is appropriate to regulate the sales of trailers <br />_ conforming to the above definition in the same way as the automobiles that tow them. <br />_ 5.2 Section 1007.015 (Industrial District Uses) of the City Code allows motor vehicle sales in <br />_ an I-2 district as a coNDiT1oNAL usE. Since the subject property is within an I-2 district, <br />_ therefore, staff has determined that trailer sales may be allowed as a coNDiT1oNAL usE. <br />_ 5.3 Section 1014 of the Roseville City Code allows the City Council to review uses that are <br />_ coNDiT1oNALLY PExMiTTED in a zoning district and, in order to protect the public health, <br />_ safety, and general welfare, may approve such a use, imposing any additional conditions <br />� deemed necessary that are above and beyond the licensing requirements or other <br />� operating regulations. Planning Division staff recommends that the parking/display/sales <br />� area used for the trailer sales be required to comply with the normal parking requirements <br />� for I-2 districts established in �1007.01 (Industrial Setbacks) which generally include: <br />� a. Paved area with concrete curb and gutter and a 20-foot setback from the adjacent <br />� rights-of-way lines; <br />� b. <br />c. <br />Landscaping/screening within the setback that is 80% opaque and 3 feet tall; and <br />Storm water treatment and rate control for all new parking area pavement. <br />6.O REVIEW OF CONDITIONAL USE PERMIT CRITERIA <br />� 6.1 Section 1014.01 (Conditional Uses) of the City Code requires the Planning Commission <br />F and City Council to consider the following criteria when reviewing a coNDiT1oNAL usE <br />F proposal: <br />F a. Impact on traffic; <br />F b. Impact on parks, streets, and other public facilities; <br />F c. Compatibility of the site plan, internal traffic circulation, landscaping, and <br />F structures with contiguous properties; <br />F d. <br />F e. <br />f. <br />Impact of the use on the market value of contiguous properties; <br />Impact on the general public health, safety, and welfare; and <br />Compatibility with the City's Comprehensive Plan. <br />PF09-015_RCA_062909 (2).doc <br />Page 2 of 4 <br />
