Regular City Council Meeting <br />Monday, July 13, 2009 <br />Page 7 <br />peared to be no likelihood for a road in that area; and spoke in support of the mo- <br />tion. <br />City Manager Malinen clarified that the $2 million acquisition cost referred to by <br />Councilmember Ihlan, while paid upfront by .the City, would be allocated to the <br />development costs for the area. City Manager Malinen noted that the roadway <br />and round about referenced in this discussion was already under construction and <br />the right-of--way was already being utilized, and that this vacated area did not <br />align with that roadway. <br />Councilmember Johnson concurred with the comments of Councilmember Roe, <br />and spoke. in support of the motion; opining that Prior Avenue provided and sup- <br />ported sufficient north/south access for future roadway construction. <br />Roll Call <br />Ayes: Pust; Roe; Johnson; and Klausing. <br />Nays: Ihlan. <br />Motion carried. <br />Roe moved, Johnson seconded, conveying, through Quit Claim Deed, the two ten- <br />foot strips shown on Attachment B and legally described in Attachment D of the <br />Request for Council Action dated July 13, 2009, to the adjoining property owners. <br />Councilmember Ihlan spoke in opposition to this motion for those reasons previ- <br />ously stated. <br />Councilmember Roe reiterated his comments related to the City's past practice of <br />returning rights-of--way back to property owners if there was no public use pro- <br />posed. <br />Roll Call <br />Ayes: Pust; Roe; Johnson; and Klausing. <br />Nays: Ihlan. <br />Motion carried. <br />9. General Ordinances for Adoption <br />a. Adopt an Ordinance Amending Title 4 of the City Code Regarding Yard Re- <br />quirements and Regulation of Residential Composting <br />Recycling Coordinator Tim Pratt provided a brief update to Councilmembers on <br />revisions and clarifications made to the draft ordinance amending Title 4 of City <br />Code related to yard requirements and regulation of residential composting, as <br />previously discussed by Councilmembers and staff. These clarifications were de- <br />tailed in the Request for Council Action dated July 13, 2009, and related to Sec- <br />tion 407.02, and addition of a new chapter regarding compost bins. <br />
