Violation. Except as provided in Section 90'7.05(1), arcy person that maintains a rental <br />dwelling unit without having the prope�2y registered, or after the registration for the prope�y has been <br />revoked or suspended, or who pennits new occupancy in violation of section 907 is guilty of a <br />misdemeanor, c�l upon conviction is subject to a fzne c�l imprisonment as prescribed by state law. Ivl <br />addition to, or in lieu of, charging a misdemeanor, the City may impose administrative feesin cm amount <br />set in the City Fee Schedule. Administrative feesmay be appealed pursucmt to section 90715. Upon the <br />failure to �y cm administrative fee c�l to appeal the fee within the p�eNiod established in section 907.1 S of <br />this section, the City may p�ost the dwelling unit as illegal for habitation. Thereafter, the dwelling unit <br />may not be occupied by arcyone other than the primaYy homestead owner c�l that person's immediate <br />family until (a� the administrative fee has been paia�� (b) a rental registration is obtained or the City is <br />satisfzed that the dwelling unit will not be used as a rental dwelling unit, cnxl (c) completion of any <br />abatement, written compliance order, legal action from a citation or action � City Code Sections 407.06, <br />407.07 c�l 407.08. Each day ofeach violation constitutes a separate offense. <br />Section 907.11. OwnerlAgent Responsibility. h shall be the responsibility ofthe owner, or its agent to <br />take appropriate action followingconduct by tenant (s) or guests of the tenant (s)which is in violation of <br />arcy oftkze followingstatutes or ordinances: <br />r�. Minn. Stat. 609.75 through 609.76, which prohibit gambling; <br />F� Minn. Stat. 609.321 through 609. 324 which prohibit prostitution c�l acts relating thereto; <br />�. Minn. Stat. 152.01 through 152.025, c�l 152.027, subds.l cnxl 2, which prohibit the unlawful sale <br />or possession ofcontrolled substances; <br />L� . Minn. Stat. 340A.401, which regulates the unlawful sale ofalcoholic beverages; <br />Mii�n. Stat. 609.33, which prohibits owning, leasing operating managing maintaining or <br />conducting a disorderly house, w° inviting or attempting to invite others to visit or remain in a <br />disorderly house; <br />J'. Minn. Stat. 97B. 021, 97B. 045, 609. 66 through 609. 67 c�l 624.712 through 624.716 c�l Chapter <br />103 of the City Code, which prohibit the unlawful possession, transportation, sale or use of <br />weapon; <br />�. Minn. Stat. 609. 72, which prohibits disorderly conduct; <br />L'.. Roseville City Code Section 407, prohibiting public nuisances, Section 405, noise control, <br />Section 906, properiy maintenance, Section 1004 cnxl 1005, lcmd use c�l Section 1018, parking; <br />� <br />Minn. Stat. 609.221, 609.222, 609.223, 609.2231, c�l 609.224 regarding assaults in the fzrst, <br />second, third, fourth,c�l fiftl�legree. <br />Three violations ofarcy ofthe above referenced laws at arcy �cr�ticular location within a given 12 month <br />period may result in loss of properly registration. The City will provide written notice ofeach violation to <br />the owner or its agent by mail. Notice shall be effectiveifmailed to the owner or agent at that person's <br />last known address. <br />
