Ti�ir <br />13 recommendationto the I-ll��. was to remove a specific provision in the Prosecuting Attoz�ney's <br />1�G contract (inserted in appro�mately 2002) which „�+{�,i �x�l Community Developm�nt code <br />] 5 enforcement sfaffio obtain City Council approval before it could issue a Ramsey County Court <br />]� Citation for a violation of the City Code. The I�RA then amended this by recommendingto City <br />1 r Council that the � be involved in reviewing the Code Enforcementprocess for citations and <br />L.3 abatements to include "�h� review of a policy regarding use of inediation, eminent domain, <br />l 9 abatement and court citation". It was then decided to discuss code enforcementprocedures at a <br />20 City Council Study Session in August so that City Council could give direction �n these issues. <br />21 2.2 It has also be�n suggested to Roseville's City Council that Community Development's <br />y�' procedures regarding enforcement of the land use provisions of Roseville's �'i �}� Code <br />�� need addressing and that staff is not following those procedures specified within the <br />�?� code. City staff, as well as the City Attarney, feel that legal procedures are in fact being <br />�� properly followed and that the alternativeinterpretationbeing put forward is not a correct <br />�+.i interpretation or a realistic alternative. <br />�? 2.3 Prior to year 2002 the Community Development�epartrrzeni had the authority to issue <br />�S Ramsey County Court Citations for violations of Roseville's City Code. Before a court <br />�.� citation was issued the Community Development Director, the City Attorney, the <br />3� Prosecuting Attorney and the Codes Coordinatorall had to agree this was appropriateand <br />� � the most effective method to achieve compliance. Citations were typically issued after at <br />�� least three notices had been sent to the property owner, but without success (staff first <br />�� attempts to work with property owners and allow adequate time for the property owner to <br />3� obtain compliance with City Codes).
