1 REQUEST FOR COUNCIL ACTION <br />� <br />3 Date: 1/29/2007 <br />4 Item No: 3,�' <br />6 Department Approval: ���r���e ��ti��=„ Agenda Section: <br />r �� •�� � � l l�A"�'i' � �_ � _ . �'t�.n�n I <br />9 Item Description: Selecting Twin Lakes Legal Counsel <br />I �i <br />LL <br />� � Background <br />1� The City of Roseville, along with over 800 Minnesota cities, participates in an insurance pool <br />L� sponsored by the League of Minnesota Cities for properiy and liability coverage. When claims <br />i S are made against the City, the City forwards the claim to the League to determine; 1} if coverage <br />1�G is available under the Policy, and 2) the law firm that is in the best position to defend the City <br />y' against the claim. <br />]� <br />]� With respect to land-use claims, the League has historically used one of five different firms in <br />�� the metro area, including the law firm of Iverson Reuvers. Iverson Reuvers has been <br />�? ] representing the City on Twin Lakes-related claims for the past two years. <br />�� <br />�� While the Council could select a different firm to represent the City, it would require <br />�� considerable time and resources for that firm to become familiar with the history of the Twin <br />�� Lakes Redevelopment Area, as well as the related legal actions that have occurred in the past. <br />��a The City's insurancepolicy vviih the League specifies that the City and the League will mutually <br />�� agree on which law firm to use — if the City wishes to remain covered under the Policy. <br />�$ Certainly the City has discretion to select a different firm; however, all costs would then be <br />�9 borne by the City. <br />3+J <br />� l As previously directed by Council last fall, City Staff did approach other land-use attorneys to <br />�� determine whether they would be interested in assisting the City of Twin Lalces matters. Three <br />33 firms replied affirmatively. Copies of those responses are attached. <br />�� <br />3 � Council Action Requested <br />�� Approve the selection of the Iverson Reuvers law firm to continue representing the City on Twin <br />�? Lakes litigation matters. <br />3� <br />� <br />
