Consider Adoption of a Resolution approving the Request of Kimco Re- <br />alty and Starbucks Coffee for a Conditional Use Permit for a Stand- <br />Alone Fast Food Drive-thru and Restaurant, 1800 Highway 36 (�'F07- <br />009) <br />Community Development Director John Stark presented and reviewed the <br />request of Kimco Realty for approval of a Conditional Use Permit to allow <br />the construction of a stand-alone Starbucks Coffee (referred to as a Class �� <br />Fast Food Restaurant in $1005.015) with a single-lane drive thru. Mr. Stark <br />noted that the structure would be constructed on the west side of the former <br />Frank's Nursery and Crafts building adjacent to Fairview Avenue. Mr. Stark <br />noted that the only reason the issue was before the Council was for a CUP to <br />accommodate the drive-thru. <br />Staff recommended approval of the CUP; along with the PC on a 610 vote, <br />based on comments in Section 5, findings of Section 6 and the eight revised <br />conditions in Section 7 of the project report dated February 26,2007. <br />Discussion included rationale for placement of the trash enclosure; and ana- <br />lysis of traffic flow based on the adjacent child care facility. <br />Mr. Stark advised that, since the Public Hearing held at the Planning Com- <br />mission level, staff had received a letter of opposition dated February 19, <br />2007, from several adjacent neighbors. <br />Substantial discussion ensued regarding traffic control on Fairview; truck <br />and other vehicular traffic and it's maneuvering on site as well as ingress <br />and egress points and shared roadways. <br />Mayor Klausing clarified that the CUP application was for Starbucks' use of <br />a drive-thru only; not whether or not overall land use was opposed. <br />
