EXTRACT OF THE FEBRUARY 7,2007 <br />ROSEVILLE PLANNING COMMISSION <br />MEETING MINUTES <br />c. PLANNING FILE 07-009 <br />Request of Kimco Realty and Starbucks Coffee for a CONDITIONAL USE PERMIT at 1800 Highway 36 <br />(former Franks site) to allow the construction of a 2,000 square foot Starbucks Coffee with drive-thru (to <br />be located between �airview Avenue and existing structure) <br />Chair �akeman opened the Public Hearing for Planning File 07-009. <br />City Planner Thomas Paschke presented the requestof Kimco Realty and Starbucks Coffee allowing <br />construction of a stand-alone Starbucks Coffee (referred to as a Class II Fast Food Restaurant in City Code, <br />Section 1005.015) near the southwest corner of the site at 1800 Highway 36 (former Franks Nursery & Crafts <br />building adjacentto Faf�+i����Avenue), with a single-lanedrive-thru. <br />Mr. Paschke noted that the area was currently undergoing installation of storm water management devices and <br />other site preparation improvementsfor future projects, in conjunction with permits recently issued for <br />remodeling of the former building into a Golfsmith Golf and Tennis at the site. Mr. Paschke advised that those <br />improvements had required that the area be restudied for any additional adverse impacts, including peak hour <br />traffic studies at Fairview Avenue and the frontage road, in addition to traffic flow and parking on the site itself. <br />Mr. Paschke noted that the study was not yet finalized, but prior to the case being heard by the City Council, <br />staff would have completed their analysis; and would finalize conditions related to truck traffic on-site and <br />around the main building, including radius issues and design concerns; traffic flow from semi vehicles and their <br />ingress and egress, thus the need for the conditions to allow staff to work with the applicant (Condition f} <br />regarding shared access implementations by the applicant (Kimco Realty) and the adjoining property owner. <br />Mr. Paschke reviewed the functionalityof the site with no specific easements in place limiting vehicle access; <br />previous project reviews and a lack of follow-through with the properties changing hands repeatedly. Mr. <br />Paschke advised that, basically staff was supportive of this project, pending additional review between now and <br />City Council review, recognizing additional modifications may be necessary to the site plan to meet all criteria <br />related to the CUP. Mr. Paschke advised that additional traffic was anticipated, but that no dramatic impacts on <br />�airview Avenue or the frontage road were anticipated, based on the specifics of the design standards; design <br />of the tum lane; location of the structure, drive lanes and stacking considerations. Mr. Paschke noted that the <br />Design Review Committee (DRC) had reviewed the components of the project, and concurred with the overall <br />site plan, with slight modifications, specifically location of the trash enclosure closer to the building, rather than <br />across the parking lot. <br />Staff recommended approval of a CONDITIONAL USE PERMIT for Kimco Realty and Starbucks Coffee, <br />allowing the construction of a 2,000 square foot stand-alone Class (I Fast Food Restaurant with a single-lane <br />drive-thru at 1800 Highway 36, based on comments of Section 5, findings of Section 6, and conditions of <br />Section 7 of the project report date February 7.2007. <br />Discussion included location of the finro (2) nodes on the site; traffic flow proposed for Starbucks; main access <br />points and looping through the drive-thru; extension of the island to the south and eliminating parking space; <br />anticipated parking demand and peak business hours for specific tenants; landscaping specifics and improved <br />aesthetics of the site; relationship of current property owners and assurances that improvements will be made <br />and follow through provided; and recording easements against the properties to ensure compliance to the extent <br />allowed under City Code and State law. <br />Chair ����rr�ar� concurred with staffs assessment; clarifying that the application for the CUP was tied to the <br />drive-thru. <br />
