ARTICLE XI CALL BACK <br />11.1 CALL BACK: An employee called in f�r work at a time other than the employee's <br />normal scheduled shift will be compensated for a ininirriu�n of two (2) hours' pay at one <br />and one-half (1 %) times the employee's base pay rate. <br />ARTICLE XIY STANDBY <br />12.1 Effective January 1,2007, employees who are required by the City to be on standby will <br />be compensated Two Hundred Forty Dollars ($240.00) per week. The weekly amount <br />will be pro-rated according to the time frame the employee is required to be on standby <br />duty. <br />12.2 For purposes of this provision, "standby" is defined as the requirement to be available <br />during o��f duty hours for immediate call-back. An employee on "standby" is required to <br />respond to the City within one half hour to such a call. <br />ARTICLE XIIY WEEKEND AND HOLIDAY DUTY <br />FOR UTILITY DEPARTMENT EMPLOYEES <br />131 Weekend and holiday duty are a regularly scheduled function of the Utility Department, <br />and employees will be compensated in accordance with the overtime, standby, and call- <br />back provisions of the AGREEMENT. <br />ARTICLE XIV LEGAL DEFENSE <br />14.1 Employees involved in litigation because of negligence, ignorance of laws, non- <br />observance of laws, or as a result of employee judgmental decision may not receive legal <br />defense by the municipality. <br />14.2 Any employee who is charged with a traffic violation, ordinance violation or criminal <br />offense arising firoil� acts performed within the scope of t��e employee's employment, <br />when such act is performed in good faith and under direct order of the employee's <br />supervisor, shall be reimbursed for reasonable attorney's fees and court costs actually <br />incurred by such employee in defending against such charge. <br />ARTICLE XV RIGHT OF SUBCONTRACT <br />15.1 Nothing in this AGREEMENT shall prohibit or restrict the right of the EMPLOYER <br />from subcontracting work performed by employees covered by this AGREEMENT. <br />�1\rl,l���s 1���R IlI�LAI �.111TR. <br />16.1 The EMPLOYER will discipline employees only for just cause. <br />7 <br />
