1�_� An employee(s} will not be required to participate in an investigatory interview by the <br />EMPLOYER where the information gained from the interview could lead to the <br />discipline of the �mploye�(s) unless the empioye�(s) is given the opportunity to have a <br />third party present at the interview to act as a witness for the employee(s). <br />ARTICLE XVII SENIORITY <br />l- 1 Seniority will be the determining criterion for transfers, promotions and lay offs only <br />when all job-relevant qualification factors are equal. <br />I?} Seniority will be the determining criterion for recall when the job-relevant qualification <br />factors are equal. Recall rights under this provision will continue for twenty-four (24) <br />months after lay �f�, Recalled employees shall have ten (10) working days after <br />notification of recall by registered mail at the employee's last known address to report to <br />work or �`orfcit all recall rights. <br />ARTICLE XVIII PROBATIONARY PERIODS <br />I� I All newly hired or rehired employees will serve a twelve (12) month probationary period. <br />This probationary period may be extended at the discretion of the EMPLOYER for no <br />_ more than ninety (90) days. The employee shall be notified of any extensions and the <br />reasons for the extension in writing prior to the end of the initial probationary period. <br />1 K.� All employees will serve a six (6) months' probationary period in any job classification in <br />which the enl�loyee has not served a probationary period. This probationary period may <br />be extended at the discretion of the EMPLOYER for no more than ninety (90) days. The <br />employee shall be notified of any extensions and the reasons for the extension in writing <br />prior to the end of the initial probationary period. <br />l�. � At any time during the probationary period a newly hired or rehired employee may be <br />terminated at the sole discretion of the EMPLOYER. <br />l�.� At any time during the probationary period a promoted or reassigned employee may be <br />demoted or reassigned to the employee's previous position at the sole discretion of the <br />EMPLOYER. <br />ARTICLE XIX SAFETY <br />I�). I The EMPLOYER and the UNION agree to jointly promote safe and healthful working <br />conditions, to cooperate in safety matters and to encourage employees to work in a safe <br />manner. <br />;�.`'_ The EMPLOYER and the UNION agree to form a Safety Committee comprised of one <br />(1) Representative from Parks, Streets, Mechanical and Utilities, along with Management <br />Representatives. This Safety Committee will meet once per month for one (1} hour to <br />discuss safety-related issues only. <br />� <br />
