Regular City Council Meeting — DRAFT Minutes <br />Monday, April 23,2007 <br />Page 29 <br />1 Councilrnember Ihlan expressed concern about revising the motion, <br />'? opining she had qualms about the approval, but understood the motion <br />�� was to schedule the Public Hearing. <br />c <br />� <br />�� <br />� <br />� <br />� <br />10 <br />11 <br />l� <br />Councilrnember Pust advised Councilmember Ihlan that this was her <br />rationale for flagging the language in the resolution for Council��ne�- <br />ber Ihlan's review and understanding; again noting in resolution lan- <br />guage, that the approval was not binding. <br />Councilmember Ihlan expressed further concerns regarding findings <br />as detailed in the proposed resolution language. <br />1:� City Manager Ma���e�. concurred with Ms. Ihlan's interpretation of <br />1�+ the intent of Bond Counsel, and the procedural necessities for the de- <br />l� veloper to proceed in making application for funding, with more far- <br />��: ma! action to be taken by the City Council at a later date. <br />]7 <br />]� Mayor Klausing recognized Councilmeinber Ihlan's concerns, but <br />�� noted language in Sections 1, 3 and 7 of the resolution language that <br />�C� were explicit to the City's preliminary approval, all subject to final <br />� 1 City Council approval. <br />�� <br />�:� Councilmember Ihlan opined that, she couldn't in all good faith, sign <br />�=� off on the findings outlined in Section 2 of the resolution; and would <br />�� need to vote in opposition to the motion, even though favoring sched- <br />��� uling the Public Hearing. <br />�� <br />�� <br />�� <br />Councilmember Pust recognized Councilinember Ihlan's viewpoint. <br />�� City Attorney Anderson concurred with the revised motion language <br />� 1 and adoption of the resolution, not as Bond Counsel, but as the City's <br />�� legal advisor; noting that the City should follow the recommendation <br />��:� of their Bond Counsel, due to the specificity and technological aspects <br />3� of that particular area of law. Mr. Anderson noted that adoption of <br />:�� this resolution also authorized preparation of the necessary documents <br />�� being requested by Councilmember Ihlan prior to further Council ac- <br />3'� tion. <br />�`� � <br />
