Mr. Lloyci noted that Mr. Re�.eo nwned the praperty a# 28Q Minnesata <br />Avenus> and had razed the former aceessory structure and replaced it with a new deiached <br />garage, with plans ta build a new home in �he sa►ne ger�eral lcscation as the form�r r�sidence. <br />Mr. Lloyd noted tha� som� neighbors were supportive of the use of the RV for li�ing quariers <br />d�aring construction; and others had expressed oppnsiiinn, eo�cerned with ti�� duration, and <br />possit�ie temparary relocafion of the RV to the street to faei[itate consiruction. <br />Staff noted prsvious approva9 for Mr. Alexander, 92Q Parker Avenue, wiih staff recqnsidering <br />support of such temporary living q�ariers based on numerous considerations. <br />Staff recornmended DENIA� af the request of Mr. C]eLeo to use his RV, ar his garage, as <br />iemporary living quart�;rs duri�g the construction of his new hame, based on ttte comments and <br />findings of Section 5 of the project report dated June 6, 2007. <br />[�iscussion among s�aff and Carrtmis�ioners included, Interirr� lJse Permii corr�patibility and <br />addiiiona! oversight r�quirements of staff and the Planning Commission 9n the use of the property; <br />proposed use not permitted under City Cocle, except �hrough an Interim Use Permit; stafF <br />rationale in not considering �ase of the r�ewly-constructed garage for iemparary living quarters <br />during the home's canstr'uction (life safety a�d fire code issues; sanitary sewer, water and �lectric <br />�iili#y connectians and f�netinning); settir�g of precedents in allowing temporary living space ti�at <br />deviates from the spirit and int�ni of singl�-family use on single-family parcels; and functian af the <br />RV in extreme ternperature or starm situatiorts and potential litigaiior� risk for the City in permitting <br />li�ing in such temparary facilities. <br />Addiiionaf ciiscussion includ�d �he stafus of ihe demolitian of the prit�tary sirt�ciure and <br />construetion of the new str�aciure; <br />Corr�r�tissioner Wazniak expressed int�res� in additional information from staff in the future re[ated <br />to the City's require�nenis far hazardou� rnaterials prior to demaiiEian. <br />Th� applicanty RAbBCt 17�1.,eA� 280 Minnesata A�enue <br />Mr. De�.en thanked the Comrr�unity Development bepar�ment for their assistance to-date; <br />clarified thai the .d�mnlition p�rmit was issues in late May, and the demolition cantraetor, <br />Boiander, had razed the strueture afier inspection far and removal of hazardaus materials. Mr. <br />QeLeo expressed great satisfae#ion in the professional job dane by �he cortfractnr throt�g�tcsut �h� <br />demoli�ian process. <br />Mr. De�eo ad�ised that h� was in possession of tl�e building permit; had ninety {9a} truckloa�s of <br />fill material braught onto the site ta alie�ia#e a drainage issue; noted that footings had beert <br />poured ear[ier iaday; ancl aniicipated basemeni walis to be poured yet this weeEc, with frarning to <br />begin sflon. Mr. DeLeo further advised tha� he anticipated that the �otase would be enclosed by <br />the end of July, with construction eorr►pieted by (�ctober 15, 20�7, at whieh tirr�e he would no <br />longer neec{ the temporary housing space; also noiing that ihe RV was schedt�led ia go ir�to <br />winter sforage at approximateiy #hat same time. <br />
