Mr. Paschke further noted that <br />prior io issuance of any building permit or site plan appraval, infrastructure designs <br />wauld need to be sized in accvrdance with City Code and the City Engineer's rewiew, <br />as well as review and appraval by the Rice Creek Watershec� District, Public Warks <br />Department and Fire Marshal. <br />Mr. �'aschke reviewed r�qu�sted action of PC and administrati�e duties for future <br />US@5 <br />Staf� recommer�ded Af�PR4VAL af the ret�uest by T4LD Develapment to R�ZONE <br />properiy at frnm B-9-B (Limited Retaii District) to B-2 (ftetail Business qistrict), based <br />on the comments af Section 5 of the ptojsct report dated July 19, 2007. <br />Discussian included a summary by staff and at the requesf oi Chair Bakeman af <br />typical uses aliawed in 8-1-� and B-2 Districts and mixed business uses; min€rrtal if <br />any pot�ntial impacts to residentiaE properiies east of the subject prope�ty given pa�t <br />uses and impacts and depending on how the site is redeveloped; siaff natificaiivn af <br />property owners as per City Code and practice with no calls received by staff; and <br />exarnpies af specialty grocery stares. <br />Comrnissioner Boerigter �uestioned sfaff or� their r�searcf� of legisiaii�e history on <br />why this specific property was zoned �-2 w�en adjoining properties on th� south were <br />B-9; and quesiioned the original intent of the City for this distinctior�. <br />Mr, Paschke advised that staff's re5earch was unable to de�ermine any past inter�t or <br />rationaie fnr the current zonin�, but nated this was not unusual in reviewing legisfativ.e <br />history of specific parcels. Mr. Paschke nnted tt�at until staff sought amendment to <br />City Cade, restaurants were a non-conforming and prohibiied us� in �-1-B zones, <br />including this parcePs former use as a restauranf. Mr. Paschke suggested that #his <br />property may have been considered for affice building potential when classiii�c! as a <br />E3-2 zone. <br />Additional discussion ensued regarding w�y grocery stores were an allnwed use in B- <br />2 zones, rather than �-1-� zones; potentiaf iext arr�enefrr�ent as p�rmi�ted use, with <br />staif preferring ta approach such a rewrite after a more fhorough review and process; <br />whether to wait to rezone #he property untii a specific plan, rather than a praspective <br />plan was in place; 5tandards andlor criteria ior rezoning; and site plans not being <br />
