5? A1fies Stores kept their land until after Herschel Avenue was constructed. They <br />thought assessments for infrastructure construction were too high - District Court <br />determined assessments were appropriate. A11ied then sold off a111and. Sometime <br />between 1959 and 1960, the A11ied land was zoned to Light Industrial to make way <br />for the Control Data Wor1d Headquarters. However, the threat of a 1aw suit by the <br />neighboring property owners was enough for Control Data which then moved to <br />Bloomington and put the land up for sa1e. <br />�_� A package of development including LaBelle's, Franks, the Learning Tree and three <br />office buildings were proposed and ultimately approved. <br />�,.� Construction began on Rosedale in 1969 and included the two anchor tenants — <br />Dayton's and Donaldson's — and a large interior ma111r�ktng the t��. <br />� <br />���F STAFF COMMENTS: <br />��. I The former Franks retail/greenhouse is a permitted use as a Lawn and Garden Center in <br />the B-1 District and the site received a SPECIAL USE PERMIT to allow outdoor display <br />of inerchandise. Banks and financial institutions with drive-thru facilities are allowed as <br />CONDITIONALUSES in the B-1-B zone and are PERMITTED USES in the B-2 zone <br />(without a conditional use permit). <br />�,� During a review of adjacent property zoning and use, the City Planner concluded <br />that the use of the adjacent Sports Authority parcelwas inappropriately zoned. <br />Specificallythe property has a zoning of B-1-B, Limited Retail District, which zone <br />does not a11ow sporting goods stores. The Circuit City use (television, radio, <br />electronics and repair) is a permitted use in the B-1-B zone. <br />��, � This conclusion related to use and zoning lead the City planner to review what <br />history could be found regarding the Frank's and other adjacent properties, for <br />which the historical background is given in Section 5 of this report. <br />�a,�4 In September 2005 Kimco representatives met with staff to review their interest in the <br />Franks site and the options available (rezoning versus planned unit development) and <br />concluded that with redevelopment a planned unit development may be appropriate, but if <br />the main Franks structure were to remain and be remodeled and the site developed with <br />an addition and/or additional structure, a rezoning would be more appropriate. <br />{�, 5 In October Kirnco representatives again met with staff to determine the necessary process <br />for a rezoning. It was at this meeting that the City Planner discussed the rezoning options <br />and suggested the B-2 zone. This specific zone was chosen mainly because of the <br />proposed bank and the existing adjoining Sports Authority site is a non-conforming use in <br />a B-1-B zone, but a use permitted (sporting goods) in the B-2 zone. <br />PF3680_RCA_010906.doc Page 3 of9 <br />
