7.7 The building materials of the remodeled Franks structure and all new structures an/or <br />additions, must meet Section 1010 (Design Standards) of the City Code. <br />8.0 STAFF RECOMMENDATION: <br />8.1 Based on the information in Section 5 of the project report dated December 7, the City <br />Planner recommends approval of the REZONING to allow the redevelopment of the <br />1800 Highway 36 (former Franks Nursery & Crafts). <br />9.0 PLANNING COMMISSION ACTION: <br />9.1 On December 7,2005, the Roseville Planning Commission held the public hearing <br />regarding the Kinra.co Realty request. No citizens or property owners were present to <br />address the Commission, but the Commission did have questions of the professional staff. <br />9.2 Specifically, Member Boerigter asked the City Planner how the Sports Authority site <br />would be zoned (B-2); Chair Traynor asked why the Frank's site was initially zoned B-1 <br />(no conclusive information — Lawn and Garden Centers are only permitted in B-1 or B-1- <br />B zone); Member Pust asked if staff had concerns over adjacent day care use (no); Chair <br />Traynor asked whether parking could be accommodated on the site (yes); Member <br />Wozniak asked for details of the parking lot connections (part of original site plan <br />approval — will be connected to allow for greater disbursement of vehicle traffic; Chair <br />Traynor indicated a concern over the rezoning and its perceived increasing impacts due to <br />a greater allowance of retail uses (City Planner stated that although the B-2 zone allows <br />more flexibility in the number of permitted uses, it is uncertain whether any of those uses <br />would have a"negative impact" on the surrounding area — specifically traffic on the <br />roads. The City Planner indicated that the B-2 zone is more appropriate for this parcel <br />and the area — due largely to the non-conforming zone on the Sports Authority parcel. He <br />further indicated that whatever the uses proposed, each will need to meet the <br />requirements of the B-2 zone for setback, parking, and other requirements of the City <br />Code and the site must meet the storm water management requirements of the City of <br />Roseville and the Rice Creek Watershed); Member White asked if the site issues could be <br />resolved in advance of rezoning (City Planner indicated that there is not site plan <br />approval required and the process requires all items to be consistent with the City Code). <br />The City Engineer added that regardless of the proposal the development/redevelopment <br />must meet storm water management requirements per the City Code and the Rice Creek <br />Watershed); Member White indicated support for the bank but was concerned with the <br />retail uses; Member Boerigter stated that the site is already retail; Member poherty <br />stated he supported the rezoning of the site — it is a compatible zone to what is occurring <br />in the area. <br />9.3 The Planning Commission voted (6-1) to recommend approval of the Rezoning from B-1, <br />Limited Business District to B-2, Retail Business District based on the information <br />provided in Section 5 of the project report dated December 7,2005. <br />PF3680_RCA_010906.doc Page 6 of 9 <br />
