Minnesota <br />The Minnesota legislature has enacted special zoning provisions applicable to group <br />homes to prohibit their exclusion from residential neighborhoods by local authorities. The <br />policy behind these provisions provides that "handicapped persons and their children should <br />not be excluded by municipal zoning ordinances or other land use regulations from the benefits <br />of normal z'eszdential surroundings." Minn. Stat. 4 462.357, subd. 6a. Section 462.357 defines <br />a"person" as follows: (1) an adult who "has mental illness, mental retardation or a related <br />condition, a physical handicap, or a functional impairment; or ... is chemically dependent or <br />abuses chemicals"; or (2) a child "who has not reached age 18."
