Welsch reviewed sta�e statute, which allows group <br />homes in single-fam�ly d'astricts and the vagueness as to what <br />the city may regulate. Mr. W�lsch saught Counci� d�rec�ion <br />as to whe�her to address t�li5 issue with legis�ative <br />representatives, s�eking claxxf cation o� sta.te statute <br />language. M�r. Welsh acknow�edged the pre-emption created <br />by Sta�e Siaiue, Section 4b2.357, bu� also �ecogn�zed �hat the <br />statute was not clear beyond al�owing "the use." Mr. Welsh <br />sugg�sted two �mmediate remedies: clarif cation of ihe <br />statu�e language adding a sentence stating group hc��nes aare <br />subject to the same additionai land use and zoning <br />requiremen�s as the next door single-fami�y hame; or <br />amendment o� the statute �o a��ow far a Ioca� Condi�ianal <br />Use Fermit (CUPj process, as it does currently in multi- <br />�amily zon�s. <br />NIr. Welsch referenced a written legal apznzon, dated January <br />fi, 20Q6, on Group Homes prepared by �he City Attorney and <br />included in tonight's agenda packet. <br />Rep. Greiling, following research and discussian with <br />administrative sta�f at the Mznnesota House and City <br />Attorneys, recommended no changes �o Stat� Siatute, but <br />instead en�arcement and consis�ent appliea�ion of �ocal <br />ordinances; keeping m�ndfi.�� a� applieation of the federal <br />Fair Housing Aet, for both group hom�s and sing��-fami�y <br />
