City Council Reglar Meetiang— 0/30/06
DRAFT Minutes - Page 23
require the removal or termination of he unlawfiil occupancy of
he structure zn violation af the provision of this code or of the
order or direction made pursuant thereto. Any action taken by
the authority having jurisdictian on such premises [may]
be charged against the real estate upon which the structure is
lacated and shall be a lien upon such real estate."
CounciImember Pust suggested that this would allow staff
discretion, in consideration of City Atiorncy Squires' commnts
regarding th authority alaready available under current City
Code.
Roll Cail
Ayes: Pust; Maschka; Ihlan and Klausing.
Nays: None.
Delete Sction lOb.4 (Violation Penalties) and alI of Seetion 107
Motion #7
Ihlan moved a variation of her proposed motion 7, to delete
Section 107.5 on transfer o ownership. Mayor Klausing
declared the mation failed for Iack of a second.
Councilmember Ihlan expressed cancern that this praision
would hamper owners or rentals or owner-occupied homes,
particularly if elderly and/or handicapped, from selling their
property unless properly maintained.
Mr. Welsch advised that this was misleading, as it was already
part of the seller's full disclasure to patential purchasers.
Councilmember Pust concurred with staff, citing the language of
Section 107.5 regarding owner urnishing disclasure ar noice;
and opined it was advantageous ar the City so Roseville
properties were left well-maintained and not "flippd" to a new
owner who would be responsible foar ovearburdened maintenance.
Public Comment
John Kysylyczyn, 3083 N Victoria Street
Mr. Kysylyczyn opind that prospective adoption o' the IPMC
had been consideared by variaus City Councils since mid-1990, so
was not being "rushed far adoption."
