Mr. Colton noted the need for care in documentation <br />for potential future litigation if the responsible parties can be <br />identified. <br />Mr. Maas noted that the School District preferred to use their <br />limited funds for students, rather than litigation costs. Mr. Maas <br />opined that it would serve as good public policy on the part of <br />the State of Minnesota and MPCA to provide funding, rather <br />than allow the site and building to remain empty. <br />Councilmember Ihlan questioned whether the application would <br />compete with the clean up funding sought for the Twin Lakes <br />redevelopment. <br />Mr. Colton responded that it was not unusual for cities to have 3- <br />4 grant applications for various projects, coming from the same <br />funding source. <br />Discussion included proof of evidence issues for liability; <br />litigation expense and time consumption; regulatory assurance <br />through a Certificate of Completion from the MPCA to protect <br />all non-responsible parties from any future liability; future <br />communication for land use and environmental issues planned by <br />the School District with the community; and the School District <br />following federal and state guidelines (including periodic public <br />meetings) for the NIl'CA's VIC program to keep legal claims <br />against any prior owners intact. <br />Public Comment <br />Dennis Dietzel, 2954 H,amline Avenue <br />Mr. Dietzel noted that he had a private well on his property. <br />Jt�hn Goedeke, 2674 Virginia Avenue <br />Mr. Goedeke noted that it was important for the City of Roseville <br />to cooperate fully with the Mounds View School District, as it <br />did impact students in Roseville, 20% of whom attend the <br />� <br />� <br />
