For the following reasons, I have decided to accept the testimony of Mr. <br />Harrell and Mr. Otto, in lieu of the required documentation, that all Olive <br />Garden employees participated in the Optional Training Program: <br />� The demeanor of Mr. Otto and Mr. Harrell suggests to me that they <br />are telling the truth and that they take their liquor serving duties <br />seriously; <br />� The letter from the terminated server in this instance indicates he <br />had been properly trained in the laws relating to serving liquor and <br />that he knew what he did on September l.Q� was wrong; and <br />The terms and conditions of my decision will not encourage other <br />licensees to try to skirt their liquor serving duties or the City's <br />enforcement program. <br />Therefore, I make the following decision: the license suspension <br />scheduled for Friday, October 11 at the Roseville Olive Garden is <br />rescinded, but the Olive Garden must: <br />1. By Friday, October 4. 2002, pay $500 to the City of Roseville to <br />cover our enforcement and hearing costs; <br />2. By Friday, October 11, either pay $500 or donate food valued at <br />that amount to a charity of Olive Garden's choice that serves the <br />poor or homeless; <br />3. Immediately begin using a sign-in sheet to reflect the attendance of <br />each and every server undergoing the Olive Garden's Liquor <br />Training Program, and henceforth accurately and promptly and <br />thoroughly maintain such a sign-in sheet, a copy of which shall <br />accompany all future documentation the Olive Garden supplies to <br />the Roseville Police Department to verify the Olive Garden's <br />participation in the Optional Training Program. <br />4. If the Roseville Olive Garden were to fail another liquor compliance <br />check, for any reason, within 12 months of the date of this letter, <br />the Olive Garden will be subject to the sanction for a second <br />offense: that is, "the mandatory minimum penalty shall be a$500 <br />fine and a one-day suspension." Roseville City Code 302.15.B.�. <br />This ordinance describes the "minimum" penalty for a second <br />offense; the City may assess a more significant penalty for such a <br />second offense and I will not rescind any portion of that penalty. <br />If you agree to these terms and conditions, kindly sign and return this <br />original, keeping a copy for your files. Also, send u s a letter signed by <br />yourself or Mr. Harrell that confirms the accomplishment of items #2 and <br />#3 within five business days of having performed those conditions; item <br /># 1 will be self-confirming in that we either receive, or not, the referenced <br />check.
