Monday, September 30, 2002 <br />James A Otto <br />General Manager <br />Olive Garden Restaurant <br />1525 County Road C <br />Roseville, MN 5 5113 <br />Re: Liquor License <br />Dear Mr. Otto, <br />This is my response to your appeal from the Chiefs September 19� <br />letter. My response is based upon the entire record in this case, <br />including the hearing on Wednesday, September 25, with you and Mr. <br />Harrell. Here are the facts. <br />On September ��'=- the Olive Garden was cited by the Roseville Police <br />Department for serving alcohol to an under-aged individual. The Olive <br />Garden does not contest this citation. Mr. Otto and Mr. Harrell <br />acknowledge and regret this liquor violation. The Olive Garden has <br />terminated the server. As a result of that violation, the Chief sent the <br />Olive Garden a one-day liquor license suspension, based on the premise <br />that the Olive Garden had not qualified for a lesser sanction as a <br />voluntary participant in the City's Optional Manager and Server Training <br />Program. That Program allows for lesser sanctions for liquor violations <br />in return for licensees such as the Olive Garden carrying out a robust <br />and aggressive liquor training program for each employee who serves <br />alcohol. <br />Here, the Olive Garden has an approved curriculum for such a liquor <br />training program, but the Olive Garden failed to use or maintain a sign- <br />up sheet verifying the attendance of each employee in their voluntary <br />training. Mr. Harrell explains that he did not receive the Chiefs April, <br />2002 letter informing him of his duty to use and maintain such a sign-up <br />sheet for liquor training. However, he insists that the server who <br />committed the violation, as well as all other Olive Garden servers, in fact <br />participated in the Training Program. The Olive Garden simply failed to <br />record the attendance of each server as required by the Chief in her April <br />letter. <br />
