(Klausing/Maschka amendment) <br />Roll Call [Original Motion as Amended] <br />Ayes: Maschka; Pust; Kough and Klausing. <br />Nays: Ihlan. <br />Recess Recess <br />Mayor Klausing recessed the meeting at approximately 8:34 p.m. <br />and reconvened at $;4I p.m. <br />y y, Consider the Alcohol Compliance Program <br />City Manager Neal Beets reviewed the City Police Department's <br />liquor compliance checks bi-annually to determine whether the <br />city's 40 on-site liquor licensees are serving alcohol to anyone <br />less than twenty-one years of age. Mr. Beets reviewed the <br />process if any establishments are found to be in violation; and <br />the licensee's right to appeal, historically to the City Manager. <br />City Manager Beets reviewed the seven appeals heard to-date <br />over the last 5 years; and comparisons to the City's other <br />compliance checks �ndlor appeals process for tobacco sales; <br />dangerous animals and traffic complaints. <br />City Manager Beets sought Council direction regarding the <br />broader policy questions and options, and reviewed the pros and <br />cons of the City Council hearing and determining appeals: <br />1) Council hears and decides all appeals from liquor <br />citations; or <br />2) Does Council want the City Manager or hislher designee <br />to hear all appeals; or <br />3) Does the Council want the City Manager or hislh�r <br />designee to hear all appeals initially but to allow licensees <br />Consider the <br />Alcohol <br />Compliance <br />Program <br />� <br />
