��e�l'�IPenf .���r�M��ad: <br />� � �4� ry <br />, �. � �� '' <br />� <br />REQUEST FOR COUNCIL ACTION <br />Manager Reviewed: <br />DATE: 04/24/06 <br />ITEM NO.: 3.4 <br />Agenda Section: <br />1����}���ti r�n � Approve Public Improvement Contract for BIRCH PARK (PF #3665} <br />Background: On January 30,2006 the City Council approved BIRCH PARK Final Plat. The <br />developer has received city approval of a 10- lot single family residential development encompassing <br />952,960, and 978 Parker Avenue. <br />As a part of this development, Ron Anderson will be constructing a cul- de- sac, sanitary sewer, <br />watermain, and storm sewer improvements. The developer has hired Larsa� Engineering to design the <br />improvements. The City will work with their Engineer during construction to ensure the improvements <br />are i::s±a�iP� according to the aYpr�vPd p�aus and City specifications. These imYrov�men*s, �nce <br />constructed, will be turned over to the City. <br />The plans have been reviewed and approved by the Public Works Department and conform with City <br />specifications for construction. The final plans have been reviewed by Capitol Region Watershed <br />district. They do not have any outstanding issues regarding the storm sewer design. The Developer has <br />drafted documents for the establishment of a home owners association to maintain the private storm pipe <br />along the west and east side of the development and the infiltration system on the east side near the <br />Parker Avenue right-of-way. <br />Policy objectives: In order to ensure that the improvements are built to City standards, we have drafted a <br />Public Improvement Contract that defines the responsibilities involved with the proposed public <br />improvements. Upon completion of the project, the developer's engineer must provide the City with As- <br />built plans. They must also provide to the City Engineer a letter certifying that the improvements were <br />constructed according to approved plans and specifications, and request that the City accept the <br />improvements. Once the City Council accepts the improvements, the two-year warranty period will begin. <br />Financial implications: All costs associated with construction of the new public improvements <br />necessary for this development will be borne by the Developer. A$500 application fee as well as a <br />$6,300 escrow is required. Appropriate surety in the form of a Letter of Credit will be provided for all <br />public improvements in the amount of 125% of the construction cost, $314,547.16 for a total of <br />$393,183.95. Once the construction of the improvenzents has been completed and accepted by the City, <br />this Letter of Credit will be released and replaced by a two-year warranty bond. <br />RECOMMENDED COUNCIL ACTION: <br />Approval of BIRCH PARK public improvement contract. <br />Prepared by: Debra Bloom <br />
